Overview

The Air Force (Canteens) Regulations 1945 were made under the authority of the Governor-General, acting on the advice of the Federal Executive Council, pursuant to the Air Force Act 1923-1941. These regulations were introduced to address the need for a structured and controlled framework for the establishment, maintenance, and administration of canteens and other amenities within the Air Force. They aimed to ensure the efficient and effective provision of goods, services, entertainment, and recreation to Air Force members. The policy objective was to provide a comprehensive regulatory structure to govern the operations of the Canteens Service, ensuring it met the needs of the Air Force personnel while maintaining financial accountability and proper management of resources. The enacting body was the Commonwealth of Australia, with the regulations coming into effect on 20 November 1945. These regulations established the Canteens Service under the control of the R.A.A.F. Canteens Service Board, which was tasked with the general administration and oversight of the Service. The Board was granted powers to manage canteen property, delegate functions, and engage employees. The regulations also outlined the composition and functions of the Board, including the ability to vest and manage canteen property for specific trusts and purposes, such as the benefit of Air Force members and their families. The regulations aimed to ensure that the Canteens Service operated efficiently and in line with the needs and standards of the Air Force.

Scope and Application

The Air Force (Canteens) Regulations, made under the Air Force Act 1923-1941, establish and regulate the Canteens Service for the Royal Australian Air Force (RAAF). These Regulations apply to the control and management of property and funds associated with canteens, including all goods, services, entertainment, and recreational facilities intended for the benefit of Air Force members. The term “canteen property” is defined broadly to include any property used for the Canteens Service, excluding property belonging to the Commonwealth or persons not affiliated with the Air Force. The Regulations are administered by the RAAF Canteens Service Board, a body corporate established under these provisions, and overseen by the Air Board. The Canteens Service Board has the authority to manage, control, and dispose of canteen property, issue directives, and make contributions to support the amenities provided to Air Force members. The Board's jurisdiction extends nationwide, and it has the power to delegate its functions to regional committees as necessary. The Regulations also outline the financial obligations and responsibilities of the Board, including the handling of penal deductions from Air Force members' pay related to canteen property damage or loss, and the investment and application of canteen funds. Notably, the Board is not held responsible for the misapplication of funds by committees or trustees to which they delegate control of canteen property.

Key Provisions

The Air Force (Canteens) Regulations, established under the Air Force Act 1923-1941, primarily focus on the establishment and management of the Canteens Service for the Australian Air Force. These Regulations (Regulations 3 and 4) establish the Canteens Service, which is to be overseen by the Air Board. The Service aims to provide goods, services, entertainment, recreation, and other amenities to or for members of the Air Force. The Air Board is tasked with the general control, supervision, management, and conduct of the Canteens Service. Furthermore, the Board has the authority to issue orders and instructions regarding the Service and its committees, as well as to regulate the Board's own meetings and proceedings. The Regulations also detail the establishment of the R.A.A.F. Canteens Service Board (Regulation 6), which is a body corporate with perpetual succession and a common seal. The Board is responsible for the administration and control of the Canteens Service and its associated property. The composition of the Board is outlined in Regulation 7, which specifies that it will consist of several members nominated by the Air Board, the Treasurer, and the Minister, with specific representation requirements. The Board can delegate its powers to its members, though such delegations are revocable at will (Regulation 5). Additionally, the Board has the authority to appoint and remove members, engage employees, and determine their conditions of employment (Regulation 7). The Board is entrusted with significant responsibilities, including taking possession and control of all canteen property, assuming debts and liabilities incurred by previous committees, and supplying goods and services to Air Force members (Regulation 8). The Board can also accept gifts and donations, invest canteen funds, and make contributions to funds for the benefit of Air Force members and their families (Regulation 8). The Air Board can appoint a Director of Canteens Service, who will act as the Board's representative in managing the Service (Regulation 9). The Board can also constitute regional committees to exercise certain delegated functions within specific regions (Regulation 10). These Regulations impose several obligations on the parties involved. The Air Board must ensure that the Canteens Service operates in accordance with the Regulations and any directives issued by the Board. The Board must maintain accurate financial records and submit audited statements to the Air Board and the Auditor-General (Regulation 14). The Board is also responsible for the prudent management of canteen property and funds, ensuring they are used for the intended purposes and in the best interest of Air Force members (Regulations 13 and 15). Breaches of these Regulations may result in civil or criminal penalties, depending on the nature and severity of the violation. For instance, misuse or misappropriation of canteen property could lead to legal action by the Board to recover any losses. Furthermore, any person found guilty of damaging or destroying canteen property could be subject to penal deductions from their pay, which would be paid to the Board (Regulation 12). The specific penalties for breaches are not detailed in the Regulations, but they would be determined in accordance with the Air Force Act and other applicable laws.
