Overview

The Agricultural and Veterinary Chemicals (Administration) Amendment Act 1994 was enacted by the Parliament of Australia to amend section 58 of the Agricultural and Veterinary Chemicals (Administration) Act 1992. This amendment was introduced to address issues surrounding the administration and collection of levies related to agricultural and veterinary chemicals. Specifically, the Act ensures that any amounts of levy or late payment penalties collected under the Agricultural and Veterinary Chemical Products (Collection of Interim Levy) Act 1994 are appropriately directed into the Consolidated Revenue Fund. The policy objective underlying this amendment is to streamline the financial administration of levies associated with agricultural and veterinary chemicals, ensuring that funds are correctly accounted for and managed within the framework of existing legislation.

Scope and Application

The Agricultural and Veterinary Chemicals (Administration) Amendment Act 1994 serves as a legislative amendment to the Agricultural and Veterinary Chemicals (Administration) Act 1992, primarily modifying section 58 of the Principal Act to include certain levies and penalties. This amendment applies to any amounts of levy or late payment penalties paid into the Consolidated Revenue Fund under the Agricultural and Veterinary Chemical Products (Collection of Interim Levy) Act 1994. The scope of this Act extends to individuals, businesses, and entities involved in the use, sale, or distribution of agricultural and veterinary chemicals within Australia, ensuring compliance with the regulatory framework governing these substances. The Act's application is nationwide, covering the entire Commonwealth of Australia, thereby affecting industries and conduct related to agricultural and veterinary chemicals. While the Act generally applies to all relevant parties, its specific provisions and enforcement are subject to the overarching regulations and standards set forth by the Principal Act and any subordinate instruments that may further define its application and scope.

Key Provisions

The Agricultural and Veterinary Chemicals (Administration) Amendment Act 1994 (C2004A04752) introduces an amendment to section 58 of the Agricultural and Veterinary Chemicals (Administration) Act 1992. This amendment is specifically aimed at integrating financial provisions related to levies and late payment penalties into the consolidated revenue fund. Under section 3 of the Amendment Act, it mandates that any amounts of levy or late payment penalty collected under section 16 of the Agricultural and Veterinary Chemical Products (Collection of Interim Levy) Act 1994 must be paid into the Consolidated Revenue Fund. This ensures that the financial mechanisms associated with the collection and management of these levies are properly accounted for and managed within the public finance system. The obligations and requirements imposed by this Act are primarily focused on ensuring the financial integration of levies and penalties into the appropriate revenue stream. By amending section 58 of the Principal Act, the Amendment Act mandates that any levies or penalties collected under the Agricultural and Veterinary Chemical Products (Collection of Interim Levy) Act 1994 must be directed to the Consolidated Revenue Fund. This requirement ensures that there is a clear and regulated process for the management of these financial instruments, aligning them with broader public financial practices and ensuring accountability and transparency. In terms of offences, penalties, or consequences for breach, the Amendment Act itself does not explicitly detail specific penalties or legal repercussions for non-compliance with its provisions. However, the overarching framework under which this Act operates, particularly the Agricultural and Veterinary Chemicals (Administration) Act 1992, would apply. Generally, breaches of provisions within this legislative framework could lead to civil or criminal penalties, including fines or imprisonment, depending on the severity and nature of the breach. The precise penalties would be determined in accordance with the relevant sections of the Principal Act and other applicable laws. The focus of this Amendment Act is primarily on ensuring proper financial administration rather than detailing penal consequences for non-compliance.
