Overview

The Agricultural and Veterinary Chemical Products (Collection of Levy) Amendment Act 1994 was enacted to make amendments to the Agricultural and Veterinary Chemical Products (Collection of Levy) Act 1994, aiming to address gaps and issues that emerged following the initial implementation of the principal Act. The Act was introduced by the Parliament of Australia and was assented to on 21 June 1994. The objective of this legislation was to refine and update the collection of levies related to agricultural and veterinary chemical products, ensuring more effective regulation and compliance. The Act includes various amendments such as changes to definitions and the repeal of certain sections, which collectively aim to streamline the levy collection process and enhance the overall regulatory framework for agricultural and veterinary chemicals.

Scope and Application

The Agricultural and Veterinary Chemical Products (Collection of Levy) Amendment Act 1994 amends the Agricultural and Veterinary Chemical Products (Collection of Levy) Act 1994, modifying the collection of levies on agricultural and veterinary chemical products. This Act applies to entities involved in the manufacture, import, or supply of these products within Australia, and it affects the financial obligations of those entities under the amended levy structure. The legislation is framed at the Commonwealth level, meaning it applies across the entirety of Australia and is not limited to any specific state or territory. The amendments made by this Act include specific changes to definitions and rates of the levy, thereby altering the financial burden on those engaged in the production and distribution of these chemicals. The Act also repeals certain sections of the Principal Act, reflecting a streamlining of the legislative framework. No specific exclusions or exemptions are mentioned in the provided text, though it is implied that the changes apply broadly to the designated entities and activities unless otherwise specified in subordinate instruments.

Key Provisions

The main operative sections of the Agricultural and Veterinary Chemical Products (Collection of Levy) Amendment Act 1994 (section 3) make specific amendments to the Agricultural and Veterinary Chemical Products (Collection of Levy) Act 1994. These amendments include the removal of subparagraph (a)(i) from the definition of “prescribed date for payment” (section 3(1)(a)), the omission of the number “10” from the definition of “rate of levy” (section 3(1)(b)), and the repeal of sections 7 and 10 of the Principal Act (section 3). Additionally, the amendment involves modifications to the rates of levy by removing the number “7” from various subsections (sections 3(1)(c), 3(1)(d), and 3(1)(e)). The obligations imposed by the Act on the parties or entities it governs primarily concern the collection and payment of levies related to agricultural and veterinary chemical products. The amendments seek to streamline the definition of levy-related terms, which would impact how levies are calculated and collected. By omitting specific numbers and subsections, the Act aims to simplify the levy process, potentially reducing administrative burdens and ensuring more accurate assessments. There are no explicit provisions detailing offences, penalties, or consequences for breaches within the text provided. However, it is typical for legislative amendments to maintain the penalties and enforcement mechanisms of the original Act unless explicitly altered. Therefore, the consequences for non-compliance would likely follow those outlined in the Agricultural and Veterinary Chemical Products (Collection of Levy) Act 1994, including potential civil or criminal penalties as stipulated by that Act. Given the amendments focus on definitions and rates, the primary implication for the governed parties is ensuring their compliance with the new definitions and rates as stipulated in the amended Act. Failure to adhere to these updated terms could result in non-compliance with levy regulations, potentially leading to enforcement actions under the broader legislative framework of the Principal Act.
