Overview
The Aged Care Act 1997 was enacted to provide a framework for the regulation of aged care services in Australia, addressing the need for consistent and quality care for elderly Australians. This legislation was introduced by the Parliament of Australia to ensure that aged care services met specific standards and that recipients of care were provided with adequate support and subsidies. The Act aims to facilitate the provision of flexible care subsidies to eligible recipients, ensuring that they can access the care they need with financial support. In this context, the Minister for Ageing, Julie Bishop, issued a determination under the Act on 1 April 2004, specifying the rate of the Flexible Care Subsidy for the SCOPE Service in Carnarvon, Western Australia, at $77.40 per place per day. This determination was made in accordance with a joint initiative between the Department of Health and Ageing and the approved provider, Churches of Christ Homes and Community Services Inc., also known as SCOPE. The policy objective is to ensure that aged care services are delivered effectively and that the financial burden on recipients is alleviated through these subsidies.
Scope and Application
The Aged Care Act 1997, as specified in the legislative instrument F2007B00475, determines the amount of Flexible Care Subsidy for a designated service, namely the SCOPE Service located in Carnarvon, Western Australia. This determination is applicable to the flexible care subsidy provided under section 52-1 of the Act for care specified in paragraph 15.24(1)(c) of the Flexible Care Subsidy Principles. It applies to the joint initiative between the Department of Health and Ageing and the approved provider, Churches of Christ Homes and Community Services Inc., operating under the name SCOPE. The subsidy amount is set at $77.40 per place per day, effective from 1 April 2004. This determination does not override any prior determinations regarding the flexible care subsidy amount under the same section of the Act. The legislation's jurisdiction is at the Commonwealth level, ensuring a uniform application across the nation in accordance with the overarching provisions of the Aged Care Act 1997.
Key Provisions
The key provisions of this legislative instrument pertain to the determination of the amount of the flexible care subsidy for the SCOPE Service in Carnarvon, Western Australia. Section 52-1(1)(a) and subsection 52-1(2) of the Aged Care Act 1997 empower the Minister for Ageing to make such a determination. The legislation specifies that the flexible care subsidy for the kind of care outlined in paragraph 15.24(1)(c) of the Flexible Care Subsidy Principles, as part of a joint initiative with Churches of Christ Homes and Community Services Inc., will be $77.40 per place per day. It is important to note that this Determination does not affect any prior determinations regarding the amount of the flexible care subsidy.
The Act imposes certain obligations and requirements on the parties involved, particularly the approved provider, Churches of Christ Homes and Community Services Inc., and the Department of Health and Ageing. Both entities must adhere to the terms set out in the joint initiative to ensure the provision of flexible care services. This includes compliance with the Flexible Care Subsidy Principles and the specific rate of $77.40 per place per day, which was determined by the Minister for Ageing. This requirement ensures that the subsidy is appropriately applied to the care provided, and that both parties are aware of their respective roles and responsibilities.
There are no specific offences, penalties, or civil/criminal consequences outlined in this particular Determination. However, any breaches of the Aged Care Act 1997 or the Flexible Care Subsidy Principles could result in sanctions, as provided by the overarching legislation. The Aged Care Act 1997 contains various sections that detail the possible consequences of non-compliance, including fines, suspension or cancellation of approval to provide aged care services, and potential criminal charges in cases of serious breaches. The exact penalties would depend on the nature and severity of the breach, as well as the specific sections of the Act that have been contravened.
