Overview
The Aged Care Act 1997 was enacted to provide a framework for the delivery of aged care services in Australia, addressing the need for consistent and equitable care for older Australians and those with disabilities. The Act establishes various mechanisms, including subsidies and support systems, to ensure that quality care is accessible. The policy objective behind the Act is to facilitate the provision of appropriate care services, enabling individuals to maintain their independence and quality of life as they age or when living with a disability. This legislative instrument, F2007B00474, issued in 2004 by Julie Bishop, the then Minister for Ageing, specifies the flexible care subsidy rates for a particular project in South Australia. This determination ensures that the Disability and Ageing Lifestyle Project, managed by the Renmark Paringa District Hospital Inc, receives the necessary financial support to deliver tailored care services to participants.
Scope and Application
The Aged Care Act 1997, as specified in the legislative instrument F2007B00474, provides a framework for the provision of aged care services in Australia, with particular attention to the financial aspects through subsidies. This legislative instrument, under the authority of the Minister for Ageing, Julie Bishop, sets out the specific rate of the flexible care subsidy applicable to the Disability and Ageing Lifestyle Project managed by the Renmark Paringa District Hospital Inc in South Australia. The subsidy rate is determined to be $30.73 per place per day for care services provided from 1 February 2004 onwards, aligning with the flexible care subsidy principles outlined in the Act. This legislation applies to the specified project and its approved provider, focusing on the financial arrangements rather than broader operational or service delivery standards, thereby ensuring that the financial support provided meets the needs of the care recipients under this particular initiative.
Key Provisions
This legislative instrument sets out the amount of flexible care subsidy payable under the Aged Care Act 1997 (sections 52-1 and 15.24). Specifically, it establishes the rate of flexible care subsidy per place per day for a particular kind of care provided by the Renmark Paringa District Hospital Inc, also known as the Disability and Ageing Lifestyle Project in South Australia. The subsidy rate is $30.73 per place per day, effective from 1 February 2004. This determination is made to ensure that the flexible care subsidy aligns with the specific needs of the project and the services it provides.
The Aged Care Act 1997 imposes certain obligations on the parties involved, particularly the Department of Health and Ageing and the approved provider, Renmark Paringa District Hospital Inc. The Department of Health and Ageing must ensure that the flexible care subsidy is accurately calculated and disbursed in accordance with the legislative instrument. The approved provider, on the other hand, must deliver the care services in line with the requirements set out in the Act and in accordance with the joint initiative with the Department of Health and Ageing. Both parties must adhere to the specified subsidy rate and ensure that it is applied correctly to the care provided.
Failure to comply with the provisions of the Aged Care Act 1997, including the correct application of the flexible care subsidy rate, may result in civil or criminal consequences. While the specific offences and penalties are not detailed in the legislative instrument, breaches of the Act can generally lead to fines, legal action, or other sanctions. The exact penalties depend on the nature and severity of the breach, and may be determined under relevant sections of the Act or other applicable legislation.
In summary, this legislative instrument establishes the rate of flexible care subsidy for the Disability and Ageing Lifestyle Project in South Australia at $30.73 per place per day. It imposes obligations on the Department of Health and Ageing and the Renmark Paringa District Hospital Inc to ensure that the subsidy is correctly applied and the care services are delivered in accordance with the Act. Non-compliance with the Act's provisions may lead to civil or criminal consequences, although the specific penalties are not detailed in the instrument.
