Overview

The Civil Aviation Regulations 1998, administered by the Civil Aviation Safety Authority, were enacted to ensure the safety of civil aviation within Australia. Among its various provisions, Part 39 outlines specific airworthiness directives, including AD/SM-260/18, which addresses the safety issue of cracked control cable eye ends in SIAI Marchetti 260 Series Aeroplanes. This legislative instrument was introduced to address reports of structural failures in the control cable eye ends of these aircraft models, which could potentially lead to catastrophic outcomes. The policy objective is to mandate a comprehensive inspection and, if necessary, corrective action to be taken on the aileron, elevator, and rudder control cable runs to ensure ongoing airworthiness and flight safety. Compliance with this directive is required within a specified timeframe following the issue date of 26 May 1994, ensuring that any identified issues are addressed promptly and effectively.

Scope and Application

The Civil Aviation Regulations 1998, specifically Part 39 - 105, addresses the safety directives for certain aircraft models, including the SIAI Marchetti 260 Series Aeroplanes. This regulation applies to the F260, F260B, F260C, and F260D models with serial numbers up to and including 848. The scope of this legislation mandates a specific action concerning the inspection and potential repair of flight control cable eye ends, as outlined in SIAI Marchetti Service Bulletin 260B55. This requirement is driven by reports of cracked control cable eye ends, necessitating a thorough inspection to ensure the continued airworthiness of these aircraft. Compliance with this directive must be achieved at the next 100-hour inspection following 26 May 1994, or before 31 December 1994, whichever comes first. The directive also references RAI AD 94-016, which further supports the need for these safety measures. The regulation is applicable nationwide within Australia and is enforced by the Civil Aviation Safety Authority (CASA).

Key Provisions

The Civil Aviation Regulations 1998, Part 39 - 105, specifically addresses the airworthiness of aircraft through a series of directives, including AD/SM-260/18 concerning the SIAI Marchetti 260 Series Aeroplanes (Section 105). This directive pertains to the inspection and, if necessary, the repair of the flight control cable eye ends for models F260, F260B, F260C, and F260D with serial numbers up to and including 848. Compliance with SIAI Marchetti Service Bulletin 260B55 is required, as referenced in RAI AD 94-016. Under this directive, operators of the specified aircraft models must conduct a detailed inspection of the eye ends in the aileron, elevator, and rudder control cable runs. This inspection is mandated at the next 100-hour inspection following 26 May 1994, or prior to 31 December 1994, whichever comes first. The directive stems from reports of cracked control cable eye ends, indicating a potential safety hazard that necessitates proactive measures to ensure the continued airworthiness of the aircraft. The obligations imposed on the parties governed by this directive include ensuring that the specified aircraft models undergo the required inspection and any necessary repairs. Operators must adhere strictly to the guidelines outlined in SIAI Marchetti Service Bulletin 260B55 to maintain compliance with the Civil Aviation Regulations. This involves a thorough examination of the control cable eye ends to detect any signs of cracking or damage and taking corrective action as specified in the service bulletin. Failure to comply with the requirements of AD/SM-260/18 may result in significant civil and criminal consequences. The Civil Aviation Safety Authority (CASA) has the authority to enforce the regulations, and non-compliance could lead to penalties. While the specific penalties are not detailed in the legislative instrument, potential consequences could include fines, suspension of the aircraft’s operating certificate, or other enforcement actions deemed necessary to ensure compliance and maintain aviation safety standards.
