Overview

The Civil Aviation Regulations 1998, as amended, include Part 39 - 105 concerning the Civil Aviation Safety Authority Schedule of Airworthiness Directives, specifically addressing SIAI Marchetti S205 and S208 Series Aeroplanes. This legislative instrument, enacted by the Australian Government and administered by the Civil Aviation Safety Authority (CASA), was introduced to address the safety issue of cracking in the propeller governor arm of these aircraft models, which could lead to a loss of propeller control. The policy objective is to ensure the airworthiness of these aircraft through mandatory inspections and, where necessary, the replacement of the propeller governor arm. The directive requires inspections according to SIAI MARCHETTI Service Bulletin 205B43A, with compliance mandated within a specific timeframe post the issuance date of the directive and at regular intervals thereafter. This directive aims to mitigate the risk of in-flight failures by enforcing stringent maintenance protocols.

Scope and Application

The Civil Aviation Regulations 1998, specifically Part 39 - 105, addresses the airworthiness directives that govern the maintenance and safety standards for aircraft within Australian airspace. This particular legislative instrument, AD/SM-205/29 Amendment 1, pertains to SIAI Marchetti S205 and S208 series aeroplanes, focusing on the inspection and replacement of the propeller governor arm. The directive applies to S205 series aircraft with serial numbers up to and including 5-406, and S208 series aircraft with serial numbers up to and including 4-64. The requirement necessitates that the propeller governor arm be inspected in accordance with the specified SIAI Marchetti Service Bulletin 205B43A, and where necessary, replaced with a steel governor arm, part number 260-13-274-01, as detailed in the bulletin. The directive was issued due to reported instances of cracking in the propeller governor arm, which could lead to a loss of propeller control. Compliance with this directive must be met within 25 hours of the directive's issue date, 10 November 1994, and thereafter at intervals not exceeding 50 hours of flight time. This directive is integral to ensuring the safety and airworthiness of the specified aircraft models within the Australian aviation sector.

Key Provisions

The Civil Aviation Regulations 1998, particularly Part 39 - 105, and the Civil Aviation Safety Authority Schedule of Airworthiness Directives, specifically AD/SM-205/29 Amendment 1, pertain to the inspection and replacement of the propeller governor arm for SIAI Marchetti S205 and S208 Series aeroplanes. These provisions apply to S205 Series aircraft with serial numbers up to and including 5-406, and S208 Series aircraft with serial numbers up to and including 4-64 (AD/SM-205/29). The requirement is to inspect the propeller governor arm in accordance with SIAI Marchetti Service Bulletin 205B43A. The fitting of a steel governor arm, part number 260-13-274-01, as detailed in paragraph "C" of SB 205B43A, is designated as the terminating action for this directive. It is noted that Italian AD 77-222 also references this directive. Compliance with this directive mandates that the inspection must be conducted unless it has already been performed, within 25 hours of time in service from 10 November 1994, and subsequently at intervals not exceeding 50 hours of time in service. The obligations imposed by this directive are clear and specific. Aircraft operators must ensure that the propeller governor arm is inspected according to the instructions provided in SIAI Marchetti Service Bulletin 205B43A. If necessary, the arm must be replaced with the specified steel governor arm, part number 260-13-274-01. This is crucial as cracking of the propeller governor arm has been reported, and failure of this component can result in a loss of propeller control, which poses a significant safety risk. Failure to comply with the requirements of AD/SM-205/29 Amendment 1 can result in serious consequences. The Civil Aviation Regulations 1998 stipulate that non-compliance with an airworthiness directive can lead to enforcement actions. While specific penalties are not detailed within the directive itself, non-compliance with airworthiness directives can generally result in civil penalties, including fines. In more severe cases, where non-compliance leads to an aviation incident or accident, criminal charges may also be applicable. The potential penalties for such violations can be significant, reflecting the critical nature of maintaining the airworthiness of aircraft as mandated by the Civil Aviation Safety Authority.
