Requirement: Replace the leg collars in accordance with Sicma Aero Seat SB 95-25-003.
Note: DGAC AD 97-134(AB) refers.
Compliance: Before 18 September 1997.
This airworthiness directive becomes effective on 6 August 1997 for Qantas and Ansett Australia, and 11 September for all other operators of this equipment.
Background: The seat manufacturer advised that a different anti corrosion treatment was used on the affected leg collars and that treatment may cause the collars not to meet the seat structural certification requirement. The manufacturer has advised that Ansett Australia is the only known operator in Australia.
Overview
The Civil Aviation Regulations 1998, as amended, are a comprehensive set of regulations designed to ensure the safety of civil aviation in Australia. These regulations were enacted by the Australian Parliament and are administered by the Civil Aviation Safety Authority (CASA). A specific part of these regulations, Part 39, deals with airworthiness directives which are legally enforceable rules related to the ongoing airworthiness of aircraft and aircraft products, parts, and appliances. One such airworthiness directive, AD/SEATS/10, addresses a safety concern related to Sicma Aero Seat Leg Collars. This directive was introduced to address the issue of corrosion on certain leg collars of aircraft seats, which could potentially compromise the structural integrity of the seats. The policy objective behind issuing this directive is to mitigate safety risks by ensuring that all affected leg collars are replaced with those that meet the necessary structural certification requirements. This directive became effective on different dates for different airlines, with the aim of ensuring compliance before a specified deadline.
Scope and Application
The Civil Aviation Regulations 1998, specifically Part 39 - 107, pertains to the Civil Aviation Safety Authority’s airworthiness directives and applies to aviation operators who use seats with specific Part Numbers and Serial Numbers equipped with leg collars as outlined in AD/SEATS/10. This directive is particularly focused on Sicma Aero Seat Leg Collars, mandating their replacement in accordance with the manufacturer's service bulletin SB 95-25-003. The directive applies to all operators of the specified seats, with a particular emphasis on Qantas and Ansett Australia, with varying effective dates set for compliance. The directive does not explicitly exclude any operators or jurisdictions within the Commonwealth of Australia, thereby imposing a broad obligation across the aviation industry. The directive extends its application through the issuance of service bulletins and airworthiness directives, which are subordinate instruments that further specify compliance requirements.
Key Provisions
The main operative sections of this airworthiness directive, AD/SEATS/10, pertain to specific seats equipped with leg collars that require replacement. These seats are identified by their Part Numbers and Serial Numbers listed in the directive. The directive mandates that the leg collars of these seats must be replaced according to the guidelines set forth in Sicma Aero Seat SB 95-25-003. The directive became effective on 6 August 1997 for Qantas and Ansett Australia and on 11 September 1997 for all other operators of this equipment. The requirement is to ensure compliance before 18 September 1997.
The obligations imposed by this Act include ensuring that the leg collars of the specified seats are replaced by the effective date of the directive. Operators must adhere to the replacement guidelines provided by Sicma Aero Seat SB 95-25-003. The directive specifies particular seats by their Part Numbers and Serial Numbers, and these seats must be identified and the necessary replacement action taken. Compliance is mandatory and must be achieved before the specified deadline.
Any failure to comply with the airworthiness directive can result in significant consequences. While the Civil Aviation Regulations 1998 do not explicitly state penalties for non-compliance with specific Airworthiness Directives, general provisions under the Civil Aviation Act 1988 could be invoked. This might include civil penalties for non-compliance, potential criminal charges if the non-compliance leads to an aviation accident or serious incident, and the imposition of fines. The exact penalties would depend on the specific circumstances and the discretion of the court or regulatory body.
