Overview

The Civil Aviation Regulations 1998, enacted by the Australian Parliament, form a comprehensive set of rules governing the safety and operation of civil aviation within Australia. The Regulations include provisions for airworthiness, including specific directives to ensure the safe operation of aircraft. Part 39 of these regulations outlines the procedures and requirements for issuing Airworthiness Directives (ADs) to address safety issues and ensure compliance with airworthiness standards. One such directive is AD/SD3-30/34, which addresses the wiring issues affecting the autofeather system in SD3-30 series aeroplanes. This directive was introduced to rectify a problem identified with the incorporation of the Shorts Service Bulletin (SB) SD330-30-30, which resulted in the inhibition of the autofeather system's operation. By mandating a rewiring procedure in accordance with the revised service bulletin, the directive aims to restore the functionality of the autofeather system, thereby enhancing flight safety. Compliance with this directive is required before 31 March 1999, underscoring the urgency and importance placed on addressing this safety issue.

Scope and Application

The Civil Aviation Safety Authority (CASA) regulations, specifically Part 39 - 105, apply to all SD3-30 series aeroplanes that have incorporated the Shorts Service Bulletin (SB) SD330-30-30 Original Issue dated June 1988. This regulation mandates the rewiring of the aeroplane in accordance with Shorts SB SD330-30-30 Revision 1 dated September 1997 to ensure the proper operation of the autofeather system. The directive is relevant to all operators and owners of SD3-30 aircraft within the Australian jurisdiction, aiming to enhance safety and maintain airworthiness standards. This directive is effective from 28 January 1999, with compliance required before 31 March 1999. The rewiring is crucial as the initial incorporation of the Shorts SB SD330-30-30 Original Issue had resulted in wiring changes that inhibited the autofeather system's operation, and the revision restores its functionality. The regulation does not specify exclusions or exemptions, indicating that all affected aircraft must comply with the outlined requirements to maintain their airworthiness certification.

Key Provisions

The Civil Aviation Regulations 1998, particularly Part 39 - 105, establish the Civil Aviation Safety Authority (CASA) Schedule of Airworthiness Directives (ADs). Specifically, AD/SD3-30/34 focuses on the Short SD3-30 series aeroplanes and mandates rewiring of the autofeather system. This directive applies to all SD3-30 aircraft that have incorporated Shorts Service Bulletin (SB) SD330-30-30 Original Issue dated June 1988 (Section 1). The requirement is to rewire the aeroplane in accordance with Shorts SB SD330-30-30 Revision 1 dated September 1997 (Section 1). This revision addresses issues that were identified in the original wiring configuration, which inhibited the operation of the autofeather system. The rewiring is necessary to restore proper functionality. The obligations under this AD are clear and precise. Aircraft operators must ensure that the wiring of their SD3-30 series aeroplanes is reconfigured in line with the specifications detailed in Shorts SB SD330-30-30 Revision 1 dated September 1997. This directive also references related communications, such as CAA(UK) AD 003-06-98 and Shorts Mandatory Service Bulletin SD330-30-33 dated June 1998, which may provide further guidance or context for compliance. Compliance with these requirements must be achieved before 31 March 1999, underscoring the urgency and importance of addressing this issue promptly (Section 1). Failure to comply with AD/SD3-30/34 could have significant legal and safety implications. The regulations do not explicitly state the penalties for non-compliance within the provided text, but it is understood that not adhering to CASA directives can result in severe consequences. This could include enforcement actions, fines, or potential grounding of the aircraft until compliance is achieved. Additionally, non-compliance could compromise the safety of the aircraft, leading to potential accidents or incidents that could result in criminal charges against the operators or responsible parties. Ensuring adherence to this directive is therefore crucial for maintaining the airworthiness and safety of the SD3-30 series aeroplanes.
