Overview

The Civil Aviation Regulations 1998, enacted by the Parliament of Australia, establish the legal framework for ensuring the safety of civil aviation within Australia. A specific legislative instrument, F2006B07098, pertains to the Eurocopter AS 332 (Super Puma) series helicopters and addresses the critical issue of maintaining airworthiness through specific airworthiness directives. This instrument was introduced to rectify safety concerns regarding the tail rotor pitch change spiders, which, if left unaddressed, could lead to significant operational risks. The policy objective is to ensure the integrity of the tail rotor hub and prevent potential failures that could compromise the safety of the aircraft and its occupants. The directive mandates regular inspections and adherence to specific service bulletins to maintain compliance and safety standards.

Scope and Application

The Civil Aviation Regulations 1998, under Part 39 and Schedule 105, governs the airworthiness directives for specific aircraft, including the Eurocopter AS 332 (Super Puma) Series Helicopters. This legislation mandates that all models of these helicopters must comply with the directives to ensure safety and prevent potential failures, such as the one addressed in AD/S-PUMA/21 Amendment 1. The requirements outlined in the directive necessitate specific actions concerning tail rotor pitch change spiders, in adherence to Eurocopter Service Bulletin AS332 No. 01.00.43 Rev 1, with references to DGAC AD 95-26-2-056(B)R1. Compliance with the directive includes performing a daily inspection and a subsequent inspection within 250 hours of service or within 50 hours if the initial compliance was met, ensuring that there is no interference between the pitch control rod and the cover. This regulatory framework applies to all operators and owners of the specified helicopter models within the Australian jurisdiction, thereby ensuring that safety standards are consistently upheld across the aviation industry.

Key Provisions

The Civil Aviation Regulations 1998, specifically Part 39 - 105, establish the requirements for the safety directives governing the airworthiness of Eurocopter AS 332 (Super Puma) Series Helicopters. Section 105 mandates that operators must comply with the AD/S-PUMA/21 Amendment 1, which pertains to the tail rotor pitch change spiders. This amendment aims to prevent failure of the pitch change spider and ensure the safety of the helicopter during operation. According to the directive, operators are required to adhere to Eurocopter Service Bulletin AS332 No. 01.00.43 Rev 1, which outlines the specific actions needed to comply with the directive. This includes conducting daily inspections of the tail rotor pitch change spiders after the effective date of the directive (13 March 1996) and performing a more thorough inspection within the next 250 flight hours following the directive's effective date. Furthermore, if the initial inspection was conducted in accordance with the original directive, operators must re-inspect the shim thickness within 50 flight hours following the effective date of this amendment (20 June 1996). Operators of the Eurocopter AS 332 (Super Puma) Series Helicopters must ensure that the tail rotor pitch change spiders are inspected and maintained as specified in the directive. This includes verifying that the shim thickness is within acceptable limits to prevent any interference between the pitch control rod and the cover. Failure to comply with these requirements may result in the helicopter being deemed unairworthy, which could lead to serious safety implications. Breach of the airworthiness directives outlined in the Civil Aviation Regulations 1998 can result in significant penalties. Operators found to be in non-compliance with these regulations may face enforcement actions by the Civil Aviation Safety Authority (CASA). This can include fines, suspension or revocation of the operator's certificate, and potential criminal charges. The severity of the penalties depends on the nature and extent of the breach, but it underscores the critical importance of adhering to these safety directives to ensure the safe operation of the aircraft.
