Overview

The Civil Aviation Regulations 1998, amended under the Civil Aviation Act 1988, introduced a framework to ensure the safety of civil aviation within Australia. One specific legislative instrument, F2006B06412, addresses the safety of the PZL M18 Dromader Series Aeroplanes through Airworthiness Directives. This instrument was enacted to address a safety concern identified with the upper fin rudder attachment of certain PZL M18 Dromader aircraft, as reported in incidents where cracks and damage occurred at the upper rudder attachment point. The objective is to ensure that these aircraft meet the necessary safety standards by mandating inspections and required actions as per FAA AD 90-17-15, Amendment 39-6678. The directive is issued by the Civil Aviation Safety Authority, reflecting the Commonwealth’s commitment to maintaining high safety standards in civil aviation through regulatory oversight.

Scope and Application

The Civil Aviation Regulations 1998, specifically Part 39 - 105, applies to the PZL M18 Dromader series aeroplanes with serial numbers ranging from 1Z001-01 to 1Z021-30. This legislation mandates action to be taken in accordance with the Technical Requirements of FAA AD 90-17-15, Amendment 39-6678, requiring inspection and reinforcement of the fin in the area of the upper rudder attachment. The applicability of this regulation extends to all persons and entities operating these specified aeroplanes within the Commonwealth of Australia, ensuring adherence to civil aviation safety standards. Compliance must be achieved by following the requirements outlined in the specified Requirement Document, with a revised effective date of 8 August 1991, as referenced in PZL-Mielec Mandatory Engineering Bulletin (MEB) No. K/02.135/89, dated 29 December 1989. The regulation does not specify exclusions or exemptions, thus encompassing all relevant aircraft within the outlined serial number range. Subordinate instruments may further detail the specific procedures and standards to be met under this regulation, extending the application and enforcement mechanisms to ensure comprehensive compliance. This includes guidance on the inspection and reinforcement process, as well as reporting requirements for operators to ensure safety and adherence to the outlined civil aviation safety directives.

Key Provisions

The Civil Aviation Regulations 1998, under PART 39 - 105, specify the Civil Aviation Safety Authority (CASA) Schedule of Airworthiness Directives. Specifically, AD/PZL/3 pertains to PZL M18 Dromader Series Aeroplanes and mandates action regarding the upper fin rudder attachment. This directive applies to aircraft with serial numbers ranging from 1Z001-01 to 1Z021-30 (s. 1). The requirement outlined in this directive is for the aircraft to be actioned in accordance with the Technical Requirements of FAA AD 90-17-15, Amendment 39-6678, which includes inspection and reinforcement of the fin in the area of the upper rudder attach point (s. 2). The obligations imposed on the parties governed by this directive include ensuring that the necessary inspections and any required reinforcement of the fin in the specified area are performed. This must be carried out as per the Technical Requirements detailed in FAA AD 90-17-15, Amendment 39-6678. Operators and owners of PZL M18 Dromader Series Aeroplanes within the specified serial number range must comply with these requirements to maintain the airworthiness of their aircraft (s. 3). Compliance with the directive is to be achieved as specified in the Requirement Document, which has a revised effective date of 8 August 1991. Failure to comply with this directive can result in serious consequences. The Civil Aviation Regulations 1998 establish penalties for non-compliance with airworthiness directives, which can include both civil and criminal penalties. Civil penalties may include fines, while criminal penalties could lead to imprisonment, reflecting the seriousness of not adhering to safety standards set by the CASA. The exact penalties are outlined in other sections of the Civil Aviation Regulations, but the potential for significant financial and legal repercussions underscores the importance of compliance (s. 4).
