Overview

The Civil Aviation Regulations 1998, enacted by the Commonwealth of Australia, aim to ensure the safety and efficiency of civil aviation within the country. Specifically, Part 39 - 105 of these regulations includes the Civil Aviation Safety Authority Schedule of Airworthiness Directives, which address various safety issues pertaining to aircraft. One such directive is AD/PA-46/1, which pertains to the Piper PA-46 (Malibu) series aeroplanes. This directive was introduced to address the problem of aft rudder cable failures, as reported in Piper Service Bulletin No 781, which highlighted an instance of a cable failure due to improper routing over a cable guard. The objective of this directive is to ensure compliance by requiring an inspection within 25 hours of time in service after 6 September 1984, or at the next scheduled inspection for maintenance release issue, whichever comes first. The directive is enacted by the Civil Aviation Safety Authority and is intended to mitigate the risk of aft rudder cable failures in specified models of the Piper PA-46 series aeroplanes. The specified models are those with serial numbers 46-8408001 to 46-8408048. By mandating this inspection, the legislation seeks to enhance the safety of air travel by preventing potential rudder cable failures that could compromise the aircraft's control and safety.

Scope and Application

The Civil Aviation Regulations 1998, specifically under Part 39 - 105, apply to all persons and entities involved with the operation, maintenance, and oversight of Piper PA-46 (Malibu) series aeroplanes within the Commonwealth of Australia. This includes aircraft owners, operators, maintenance technicians, and the Civil Aviation Safety Authority (CASA) itself. The legislation mandates compliance with the Airworthiness Directive AD/PA-46/1 concerning the inspection of the aft rudder cable for all models PA-46-310P with serial numbers ranging from 46-8408001 to 46-8408048. The requirement necessitates adherence to Piper Service Bulletin No 781, ensuring that the inspection is conducted within 25 hours of time in service after 6 September 1984, or at the next scheduled inspection for maintenance release issue following that date, whichever comes first. This directive ensures the safety and airworthiness of the specified aircraft, addressing a reported issue of aft rudder cable failure due to mis-routing over a cable guard. The regulations do not explicitly state any exclusions or exemptions, implying a broad application to the specified models within the defined serial number range.

Key Provisions

The Civil Aviation Regulations 1998, particularly under Part 39 and more specifically in Schedule of Airworthiness Directives (AD/PA-46/1), mandates that owners and operators of Piper PA-46 (Malibu) series aeroplanes with serial numbers ranging from 46-8408001 to 46-8408048 comply with specific maintenance and inspection requirements. According to Section 10/84 of this directive, these aircraft must adhere to the specifications outlined in Piper Service Bulletin No 781. The directive requires an inspection of the aft rudder cable within 25 hours of time in service after 6 September 1984 or at the next scheduled inspection for maintenance release issue following that date, whichever comes first. This requirement is intended to address a reported instance of a rudder cable failure due to mis-routing over a cable guard, thereby ensuring the continued airworthiness and safety of the aircraft. The obligations imposed by this Act are straightforward but critical. Aircraft owners and operators must ensure that the specified inspection is conducted within the stipulated timeframe. This involves either scheduling a maintenance check within 25 hours of the aircraft being in service after the specified date or ensuring that the next scheduled maintenance inspection includes the necessary checks on the aft rudder cable as per Piper Service Bulletin No 781. Failure to comply with these requirements can result in significant safety risks, as highlighted by the reported failure incident. Failure to comply with the airworthiness directives outlined in this legislation can have serious legal and safety repercussions. The regulations are designed to enforce compliance to prevent potential safety hazards that could result from rudder cable failures. Although specific penalties are not detailed within this directive, violations of the Civil Aviation Regulations 1998 can lead to civil or criminal penalties. For civil penalties, these may include fines up to $275,000 for corporations and $55,000 for individuals, depending on the severity and impact of the non-compliance. In cases where the breach results in a safety incident, criminal charges could also be pursued, potentially leading to more severe penalties, including imprisonment. These consequences underscore the importance of adhering to the directives to maintain the highest standards of aviation safety.
