Overview

The Civil Aviation Regulations 1998, amended in 2006, form part of the legislative framework governing aviation safety in Australia. This particular instrument addresses issues related to the airworthiness of Piper PA-31 series aeroplanes, specifically targeting the elevator torque tube. The Civil Aviation Safety Authority, under the authority of the Australian Parliament, enacted this regulation to ensure that aeroplanes remain in a safe condition for operation. The policy objective behind this directive is to mitigate the risk of structural failure in the elevator torque tube by mandating regular inspections and maintenance, thereby enhancing the overall safety of civil aviation. The regulation applies to all models of the Piper PA-31 series that have not been modified in accordance with Section 11 of Piper Service Bulletin No. 284. Operators are required to remove and inspect the elevator torque tube assembly at intervals not exceeding 100 hours of time in service. This includes dismantling the horn assembly and brackets, removing the finish from the tube, and conducting a detailed inspection for any signs of cracking using either dye penetrant or magnetic particle methods. Compliance with these inspection requirements is essential for maintaining the airworthiness of the aircraft and ensuring safe flight operations.

Scope and Application

The Civil Aviation Regulations 1998, specifically Part 39 - 105 under the Civil Aviation Safety Authority Schedule of Airworthiness Directives, pertains to the Piper PA-31 Series Aeroplanes. The regulations apply to all models of the Piper PA-31 series that have not been modified in accordance with Section 11 of Piper Service Bulletin No. 284. The directive mandates the removal and inspection of the elevator torque tube assembly to ensure airworthiness and safety standards are maintained. The requirement involves dismantling the horn assembly P/N 40006-00 and brackets P/N 40066-00 from the torque tube, removing the finish from the tube, and inspecting for any cracking using either dye penetrant or magnetic particle inspection methods. Compliance with these directives is mandatory at intervals not exceeding 100 hours of time in service, ensuring that all applicable aircraft meet the safety standards set forth by the Civil Aviation Safety Authority. The regulations apply across the Commonwealth of Australia, overseen by the Civil Aviation Safety Authority, and are integral to ensuring that aircraft operations meet national safety standards. These directives extend to all operators and owners of the specified Piper PA-31 Series Aeroplanes within Australia's jurisdiction, ensuring a consistent approach to airworthiness and safety throughout the country. The regulations do not provide specific exclusions or exemptions beyond the noted modifications in Piper SB No. 284, and compliance is strictly enforced to maintain high safety standards in civil aviation.

Key Provisions

The key operative sections of the Civil Aviation Regulations 1998, specifically PART 39 - 105, outline the requirements for maintaining the airworthiness of Piper PA-31 Series aeroplanes. Section AD/PA-31/4 Amendment 1 addresses the elevator torque tube inspection for all models not modified in accordance with Section 11 of Piper Service Bulletin No. 284 (Section 12/68). The requirement is to remove the elevator torque tube assembly from the aircraft and dismantle the horn assembly and brackets, then inspect the tube for cracks using dye penetrant or magnetic particle methods. This legislation imposes obligations on the operators and maintenance personnel of Piper PA-31 Series aeroplanes to ensure compliance with the specified inspection procedures. They must dismantle the specified parts, remove the finish from the tube, and conduct the inspection for cracks within the stipulated intervals, which should not exceed 100 hours of time in service. This ensures that the aircraft remains airworthy and meets safety standards set forth by the Civil Aviation Safety Authority. Failure to comply with these airworthiness directives can lead to significant consequences. If an operator or maintenance personnel neglects to perform the required inspection and any damage or defect is found during an official inspection, it could result in penalties. The specific penalties for non-compliance are not detailed in the provided text, but they could include fines, grounding of the aircraft, or even criminal charges in cases of severe negligence or resultant accidents. The severity of the penalty would depend on the extent of the non-compliance and any resultant safety issues.
