COMMONWEALTH OF AUSTRALIA (Civil Aviation Regulations 1998), PART 39 - 105 CIVIL AVIATION SAFETY AUTHORITY
SCHEDULE OF AIRWORTHINESS DIRECTIVES
Partenavia P68 Series Aeroplanes
AD/P68/38
Amdt 2
Applicability: Model P68 Series.
Stabiliser Drive Horn 9/92
Requirement: 1. Action in accordance with Partenavia SB P68-87 Revision 1.
2. Check the reference lines and the bolt torque in accordance with Partenavia SB P68-87 Revision 1.
Note: RAI AD 92-077 refers.
Compliance: 1. Unless already accomplished; within 50 hours time in service after 20 August 1992, and thereafter at intervals not to exceed 200 hours time in service.
2. Recheck the reference lines and the bolt torque within 25 hours time in service after the accomplishment of Requirement 1, or, within 25 hours time in service after 20 August 1992 if Requirement 1 is already accomplished.
The compliance of the previous issue of this Directive was:
Within 200 hours time in service after 21 May 1992, and thereafter at intervals not to exceed 200 hours time in service. This Amendment is effective from 20 August 1992.
Background: An accident has occurred and has been attributed to lack of pitch control caused by slippage of the stabiliser drive horn on the stabiliser torque tube.
Amendment 1 was raised to align this Directive with the relevant Country of Origin AD requirements.
Amendment 2 is issued to align this Directive with a revision of the Requirement Document which requires a more specific bolt torque and a new safety screw of a different material.
Overview
The Civil Aviation Regulations 1998, enacted by the Parliament of Australia, are a comprehensive set of rules governing civil aviation safety in the country. One particular part, Part 39 - 105, deals with airworthiness directives, including specific regulations for various aircraft models to ensure safety and compliance. This legislative instrument, F2006B05364, pertains to the Partenavia P68 Series Aeroplanes and aims to address the problem of stabiliser drive horn slippage, which has been linked to accidents due to loss of pitch control. The policy objective of these regulations is to maintain the highest possible safety standards for aircraft operation in Australia. The directive mandates specific actions and checks for the stabiliser drive horn, reflecting an effort to align with international standards and to mitigate the identified safety risks.
Scope and Application
The Civil Aviation Regulations 1998, specifically Part 39 - 105 pertaining to the Civil Aviation Safety Authority's Schedule of Airworthiness Directives, apply to all Partenavia P68 Series Aeroplanes with respect to the Stabiliser Drive Horn. This legislation is enforced under the Commonwealth of Australia and impacts all operators of the specified model of aircraft. The regulations establish mandatory actions for the maintenance and inspection of the stabiliser drive horn to ensure airworthiness, including specific checks of reference lines and bolt torque as outlined in Partenavia SB P68-87 Revision 1. Compliance with these directives is required within 50 hours of the aircraft being in service after 20 August 1992 and must be repeated at intervals not exceeding 200 hours of service thereafter. Additionally, a recheck of the reference lines and bolt torque is mandated within 25 hours of service after the initial compliance or after 20 August 1992 if the initial requirement has already been met. The regulations are designed to mitigate the risk of accidents due to pitch control issues caused by the stabiliser drive horn. The scope of these regulations extends to all such aircraft within Australia's jurisdiction, with no exclusions or exemptions specified in the text. The application of these directives may be further extended or clarified through subordinate instruments, but this is not indicated in the provided text.
Key Provisions
The Civil Aviation Regulations 1998, specifically Part 39 - 105, mandate specific actions for the maintenance and safety of Partenavia P68 Series Aeroplanes. Under section (AD/P68/38), the legislation requires actions in accordance with Partenavia Service Bulletin P68-87 Revision 1, which includes checking the reference lines and the bolt torque (subsection 1). Furthermore, the legislation mandates that these checks be performed within 50 hours of the aeroplane being in service after 20 August 1992, and subsequently at intervals not exceeding 200 hours of time in service (subsection 2). A recheck of the reference lines and bolt torque is required within 25 hours of the initial action, or if the initial action was already completed, within 25 hours of 20 August 1992 (subsection 3). This amendment is intended to address an accident attributed to a lack of pitch control caused by slippage of the stabiliser drive horn on the stabiliser torque tube.
Compliance with the Civil Aviation Regulations 1998 is mandatory for all entities operating Partenavia P68 Series Aeroplanes. Operators must adhere to the specified intervals for conducting checks and actions as outlined in the legislation. Failure to comply with these requirements may result in safety risks and non-compliance with civil aviation safety standards. The legislation also references a previous directive and mandates that any rechecks must be conducted within the specified timeframes to ensure ongoing airworthiness and safety of the aircraft.
Breach of the Civil Aviation Regulations 1998, particularly in relation to the requirements of AD/P68/38, can lead to significant consequences. While the specific penalties are not detailed in the provided text, non-compliance with civil aviation safety directives can generally result in enforcement actions, including fines, penalties, and potential grounding of the aircraft. These consequences are intended to ensure that all operators maintain high safety standards and comply with the requirements set forth by the Civil Aviation Safety Authority to prevent accidents and ensure the safety of all passengers and crew.
