COMMONWEALTH OF AUSTRALIA (Civil Aviation Regulations 1998), PART 39 - 105 CIVIL AVIATION SAFETY AUTHORITY

SCHEDULE OF AIRWORTHINESS DIRECTIVES

Overview

The Civil Aviation Regulations 1998 were enacted by the Australian Parliament to establish a comprehensive framework for ensuring the safety and efficiency of civil aviation within Australia. Among these regulations is Part 39, which focuses on the issuance of Airworthiness Directives (ADs) to maintain aircraft safety standards. AD/P68/36, introduced under this part, specifically targets Partenavia P68 series aeroplanes to address safety concerns related to the horizontal tailplane. This legislative instrument was created to ensure that Australian registered aircraft comply with stringent safety standards, thereby mitigating risks associated with the identified issue. The policy objective is to mandate specific modifications to the horizontal tailplane of affected aircraft models to prevent potential safety hazards, reflecting a commitment to upholding high safety benchmarks within the civil aviation sector.

Scope and Application

The Civil Aviation Regulations 1998, specifically Part 39 - 105 Civil Aviation Safety Authority Schedule of Airworthiness Directives, pertains to Partenavia P68 Series Aeroplanes with serial numbers up to and including 327. This legislation applies to the entities and individuals responsible for the operation and maintenance of these specific aircraft models within Australia, encompassing both private and commercial aviation sectors. The directive mandates compliance with technical requirements outlined in RAI AD 91-272, with a particular focus on modifying the horizontal tailplane to ensure airworthiness. Compliance must be achieved by adhering to the specified requirements within the Requirement Document, with a compliance deadline extended to 31 January 1992 for Australian registered aircraft. The jurisdictional reach of this legislation is confined to Australia, ensuring that all operators and maintainers of the specified aircraft models within the Commonwealth comply with the stipulated safety directives. The legislation does not explicitly state any exclusions or exemptions, implying that all applicable aircraft and their operators must adhere to the requirements without exception. Any further application or modifications to these directives may be extended or restricted through subordinate instruments issued by the Civil Aviation Safety Authority.

Key Provisions

The Civil Aviation Regulations 1998, under Part 39, establish a framework for ensuring the airworthiness of aircraft. Specifically, within the Schedule of Airworthiness Directives, there is a directive concerning Partenavia P68 Series Aeroplanes, identified as AD/P68/36 (section 39-105). This directive applies to Model P68 series aeroplanes with serial numbers up to and including 327. The primary requirement of this directive is that the action must be taken in accordance with the technical specifications outlined in RAI AD 91-272. It is important to note that Partenavia Service Bulletin 85 (SB 85) provides additional relevant information (section 39-105). The obligations under this directive are specific and clear. Aircraft owners and operators must ensure that their Partenavia P68 series aeroplanes meet the technical requirements specified in RAI AD 91-272. This involves making modifications to the horizontal tailplane to remove previously imposed airspeed limitations. The compliance date for these modifications is extended to 31 January 1992 for Australian registered aircraft, providing a grace period for operators to implement the necessary changes (section 39-105). Failure to comply with the provisions of this directive can result in significant legal consequences. Non-compliance with airworthiness directives is taken very seriously by the Civil Aviation Safety Authority (CASA). Operators found to be in breach of the directive may face enforcement actions, which could include fines or other penalties. In severe cases, CASA may also take steps to ground the aircraft until the required modifications are made, potentially leading to further financial and operational disruptions for the operator (section 39-105). The specific penalties for non-compliance are not detailed in the directive itself but are governed by broader aviation safety laws, which can include substantial fines and other civil or criminal penalties.
