Overview

The Civil Aviation Safety Regulations 1998, amended through the Civil Aviation Safety Regulations 1998, Part 39 - 105 Civil Aviation Safety Authority Schedule of Airworthiness Directives, represent the legislative framework designed to ensure the safety and airworthiness of aircraft operating within Australia. This legislation was enacted to address the critical need for stringent oversight and management of airworthiness directives to mitigate risks and ensure the safety of aviation operations. The Civil Aviation Safety Authority (CASA) is the responsible body, empowered to issue these directives to correct unsafe conditions that may compromise the safety of aircraft. The policy objective of these regulations is to maintain and enhance the safety standards of civil aviation by requiring aircraft owners and operators to comply with specific airworthiness directives that are issued to address identified safety concerns. The Mitsubishi MU-2 Series Aeroplanes Airworthiness Directive (AD/MU-2/70) issued by CASA on 28 May 2003, addresses a specific safety issue related to the incorrect use of clamps in certain pneumatic lines of Mitsubishi MU-2 aircraft, which could lead to leakage and loss of multiple system functions. This directive, which became effective on 10 July 2003, mandates corrective actions to be taken at the next periodic inspection or within six months from the directive's effective date, whichever is earlier. The directive references Mitsubishi MU-2 Service Bulletin 239 and aligns with Japanese AD TCD-6127-2003, underscoring the global nature of aviation safety standards and the collaborative approach taken by regulatory authorities to address safety issues.

Scope and Application

The Civil Aviation Safety Regulations 1998, specifically Part 39 - 105, mandates the Civil Aviation Safety Authority (CASA) to issue Airworthiness Directives (AD) to ensure the safety of aircraft within Australia. This particular AD/MU-2/70 issued on 7 July 2003 applies to Mitsubishi Heavy Industries Model MU-2B aeroplanes, covering serial numbers S/N 008 to 347 (excluding S/N 313 and 321) and S/N 501 to 696 (excluding S/N 652 and 661). The directive requires the application of specific actions, as detailed in Mitsubishi MU-2 Service Bulletin 239, to address the issue of incorrect clamps that could cause leakage in certain pneumatic lines and subsequent loss of multiple system functions. The compliance period mandates that the required actions must be taken at the next periodic inspection or within six months from the effective date of the directive, whichever is earlier. This directive applies across the Commonwealth of Australia, reflecting the federal oversight exercised by CASA to maintain airworthiness standards.

Key Provisions

The Civil Aviation Safety Regulations 1998 (CASR), specifically within Part 39 - 105, detail the Civil Aviation Safety Authority's (CASA) schedule of airworthiness directives. One such directive, AD/MU-2/70 dated 7 July 2003, pertains to Mitsubishi MU-2 Series aeroplanes. The directive mandates specific actions to address unsafe conditions related to the aircraft's pneumatic lines. The applicability section of the directive outlines the specific models and serial numbers of the Mitsubishi MU-2 aeroplanes affected, excluding certain serial numbers from the requirement. The requirement section mandates the actions necessary to rectify the identified unsafe condition, as detailed in Mitsubishi MU-2 Service Bulletin 239, and references Japanese AD TCD-6127-2003 for further guidance. The compliance section specifies that the required actions must be taken at the next periodic inspection or within six months from the effective date of the directive, whichever occurs first. The obligations imposed by this AD on the parties or entities it governs are clear and specific. Owners and operators of the Mitsubishi MU-2 Series aeroplanes listed in the applicability section must ensure that the specified actions are carried out. These actions include the inspection and replacement of clamps on the pneumatic lines to prevent leakage and loss of system functions. The directive requires adherence to the instructions provided in Mitsubishi MU-2 Service Bulletin 239, ensuring that the correct clamps are used and that the work is performed by appropriately qualified personnel. Failure to comply with the requirements of the AD within the specified timeframe may result in the aircraft being deemed unairworthy, thereby preventing its operation until the necessary actions are completed. Failure to comply with the provisions of this Airworthiness Directive may lead to significant legal and operational consequences. Non-compliance with the AD can result in the aircraft being deemed unairworthy, which means it cannot legally be operated until the required actions are completed. Additionally, operators who fail to adhere to the directive may face enforcement actions by CASA, including fines, penalties, or other administrative actions. The seriousness of non-compliance underscores the importance of adhering to the specified requirements to maintain the airworthiness and safety of the affected Mitsubishi MU-2 aeroplanes.
