Overview

The Civil Aviation Regulations 1998, as amended, include a specific regulation concerning the Mitsubishi MU-2 series aeroplanes to ensure the safety of air travel. Enacted by the Parliament of the Commonwealth of Australia, the regulation addresses a critical safety concern identified by the manufacturer regarding the emergency gear down gearbox of certain Mitsubishi MU-2 models. The problem at hand involves the potential failure of a lower pin in the gearbox, which could lead to significant safety risks during flight operations. The regulation mandates that certain models of the Mitsubishi MU-2 aeroplanes must adhere to Service Bulletin No 219 issued by the manufacturer, ensuring the gearbox is inspected and maintained to prevent such failures. This directive aims to safeguard the integrity of the aircraft's landing gear system, thereby enhancing overall aviation safety. The regulation is part of the broader framework established by the Civil Aviation Safety Authority to mandate specific safety directives for various aircraft types. The policy objective behind this regulation is to mitigate risks associated with mechanical failures by enforcing timely maintenance actions. By referencing the Mitsubishi MU-2 Service Bulletin No 219, the regulation underscores the importance of following manufacturer guidelines to ensure the continued airworthiness of the affected aircraft. This legislative measure is crucial in maintaining high safety standards within the aviation industry, directly contributing to the protection of passengers, crew, and the general public.

Scope and Application

The Civil Aviation Regulations 1998, specifically Part 39 - 105, mandates the application of Airworthiness Directives concerning the Mitsubishi MU-2 Series Aeroplanes, particularly the emergency gear down gearbox as outlined in AD/MU-2/55. This regulation applies to specific serial numbers of MU-2B-10, -15, -20, -25, -26, MU-2B-30, -35, and -36 models, excluding certain serial numbers, and requires compliance with Mitsubishi MU-2 Service Bulletin No 219. Compliance must be achieved unless the action has been previously carried out within 100 hours of time in service from 31 July 1994. The directive is part of the broader regulatory framework overseen by the Civil Aviation Safety Authority (CASA) and is designed to ensure the continued airworthiness of the specified aircraft models. The directive extends its applicability to all relevant aircraft operators and maintenance personnel within the Commonwealth of Australia, ensuring adherence to safety standards critical for aviation operations.

Key Provisions

The Civil Aviation Regulations 1998, particularly Part 39 - 105 (section 39.105), address the airworthiness directives for specific aircraft models, including the Mitsubishi MU-2 series aeroplanes. The specific directive AD/MU-2/55 focuses on the emergency gear down gearbox, particularly a known issue with the lower pin of the gearbox falling out of its bracket housing (section 39.105). This directive applies to certain serial numbers of MU-2B-10, -15, -20, -25, -26 and MU-2B-30, -35 and -36 models, with certain exceptions noted for specific serial numbers (section 39.105). Compliance with the directive requires actions in accordance with Mitsubishi MU-2 Service Bulletin No 219, ensuring the lower pin of the emergency gear down gearbox is secured properly to prevent it from falling out of the bracket housing (section 39.105). Under the Civil Aviation Regulations 1998, the entities governed by this directive must adhere to specific obligations and requirements to ensure the safety and airworthiness of the aircraft in question. The key obligation is to carry out the actions outlined in Mitsubishi MU-2 Service Bulletin No 219 to secure the lower pin of the emergency gear down gearbox (section 39.105). This involves inspecting the gearbox to ensure that the lower pin is properly fitted within the bracket housing, and making any necessary repairs or replacements to maintain the structural integrity and safety of the landing gear system (section 39.105). The compliance must be achieved unless the action has already been performed within the last 100 hours of time in service from 31 July 1994 (section 39.105). The Civil Aviation Regulations 1998 impose penalties and consequences for non-compliance with the airworthiness directives, including the specific directive AD/MU-2/55. Failure to adhere to the requirements outlined in section 39.105 could result in severe consequences, including the potential grounding of the affected aircraft until the necessary actions are taken (section 39.105). Although the specific penalties are not detailed in the provided text, non-compliance with Civil Aviation Regulations generally may result in substantial fines, legal action, and possible revocation of airworthiness certificates, leading to significant operational disruptions and financial repercussions for the entities involved (section 39.105).
