COMMONWEALTH OF AUSTRALIA (Civil Aviation Regulations 1998), PART 39 - 105 CIVIL AVIATION SAFETY AUTHORITY
SCHEDULE OF AIRWORTHINESS DIRECTIVES
Background: There have been reports of cable slipping from the nicopress sleeve. Maule determined that one of their tools was incorrectly set.
Bernard Malcolm Hole
Delegate of the Civil Aviation Safety Authority 1 June 2000
The above AD is notified in the Commonwealth of Australia Gazette on 7 June 2000.
Overview
The Civil Aviation Regulations 1998, enacted by the Australian Parliament, provide a comprehensive framework for ensuring the safety of civil aviation within Australia. This legislation, overseen by the Civil Aviation Safety Authority (CASA), aims to address various safety concerns and set mandatory standards to mitigate risks associated with civil aviation. One particular aspect of the regulations is the issuance of Airworthiness Directives (ADs) to address specific safety issues. For instance, AD/ML-M7/3, issued on 7 June 2000, pertains to the Maule M-7 Series Aeroplanes and specifically addresses the problem of cable slipping from the nicopress sleeve due to an incorrectly set tool identified by Maule. This AD mandates corrective actions to be taken within specified timeframes to ensure the continued airworthiness of the affected aircraft models, thereby enhancing overall aviation safety.
Scope and Application
The Airworthiness Directive (AD) issued by the Civil Aviation Safety Authority (CASA) under the Civil Aviation Regulations 1998 applies specifically to the Maule M-7 series aeroplanes, including models M7, MX7, MT7, MXT7, and M8, with specified serial numbers. The directive targets the issue of cable slipping from the nicopress sleeve, a problem traced back to an incorrectly set tool used by Maule. The AD mandates that corrective actions, as outlined in Maule Service Bulletin No. 20 dated 27 December 1999, must be implemented on certain serial numbers within 100 hours of the directive's effective date, while other serial numbers have a 25-hour compliance window. This directive, effective from 7 June 2000, ensures that the specified aircraft maintain airworthiness standards by addressing the identified safety concern. The regulation extends its reach nationally across Australia, ensuring uniform compliance among operators of the affected aircraft models.
Key Provisions
The Airworthiness Directive (AD) issued under the Civil Aviation Regulations 1998 (CAR) concerns the Maule M-7 series aeroplanes, specifically addressing issues with the nicopress sleeves on control cables. The AD applies to all models M7, MX7, MT7, MXT7, and M8, except for those future production serial numbers listed in the requirement document (sections 1a to 1e). This directive requires compliance with Maule Service Bulletin No. 20 dated 27 December 1999. The compliance timeline varies: for certain specified aircraft, the required action must be taken within 100 hours of time in service after the directive's effective date, while for others, it must be completed within 25 hours of the effective date (section 3). The directive became effective on 7 June 2000.
The AD imposes specific obligations on the operators and owners of the affected Maule M-7 series aeroplanes. They must adhere to the instructions provided in Maule Service Bulletin No. 20 to ensure the nicopress sleeves on the control cables are correctly installed or modified. This includes following detailed steps to rectify any issues with the nicopress sleeves that may lead to cable slipping. The directive requires operators and owners to ensure that the specified actions are completed within the stipulated timeframes to maintain the airworthiness of the aircraft (section 3).
Failure to comply with this Airworthiness Directive can result in severe consequences. The Civil Aviation Safety Authority (CASA) can enforce penalties under the Civil Aviation Act 1988 for non-compliance. The specific penalties for breaching ADs are not detailed in the AD itself but can include fines, suspension or revocation of aircraft certificates, and other regulatory actions. The severity of the penalty may depend on the nature and extent of the non-compliance and the risk posed to aviation safety (section 39.1(1) of CAR 1998).
