Overview

The Civil Aviation Regulations 1998, enacted by the Parliament of Australia, are a comprehensive set of rules governing the safety and operation of aircraft within Australian airspace. One particular legislative instrument under these regulations, F2006B11249, pertains to Mooney M20 Series Aeroplanes, specifically addressing issues with the baggage door inside latch. This instrument was introduced to mitigate safety risks identified with the latch mechanism, following reports of in-flight baggage door openings, some of which resulted in fatalities. The Mooney M20 Series Aeroplanes subject to this regulation include certain Mooney M20J and M20K models with specific serial numbers. The policy objective of this directive is to ensure compliance with the action specified by Mooney Aircraft Corporation SBM20-239, which is aligned with the Federal Aviation Administration’s AD 88-25-11, to be completed within 25 hours of time in service after 11 January 1989. This action is crucial to prevent similar incidents from occurring and to maintain the highest safety standards in civil aviation.

Scope and Application

The Civil Aviation Regulations 1998, as amended, apply to the Mooney M20 Series aeroplanes, specifically to those models and serial numbers listed within the scope of AD/M20/44. This legislation is pertinent to aircraft operators and owners of the affected Mooney M20J and M20K aeroplanes, requiring them to comply with the Airworthiness Directives (AD) issued by the Civil Aviation Safety Authority (CASA). The regulations are applicable nationally within the Commonwealth of Australia, impacting the aviation industry by imposing safety compliance requirements on specific aircraft models to mitigate the risk of in-flight baggage door openings. The regulations mandate corrective actions in accordance with the Mooney Aircraft Corporation Service Bulletin (SBM20-239) and reference the Federal Aviation Administration (FAA) AD 88-25-11. Operators must ensure compliance within 25 hours of time in service after 11 January 1989, underscoring the urgency and importance of the safety measures. There are no stated exclusions or exemptions within this specific directive, and the application is direct and mandatory for the identified serial numbers of the Mooney M20 aeroplanes.

Key Provisions

The Civil Aviation Regulations 1998, specifically Part 39 - 105, under the Civil Aviation Safety Authority Schedule of Airworthiness Directives, includes a directive (AD/M20/44) concerning the Mooney M20 Series Aeroplanes, focusing on the baggage door inside latch. This directive applies to certain Mooney M20J and M20K serial numbers (sections 1 and 2). The requirement (section 3) mandates that actions be taken in accordance with the Mooney Aircraft Corporation Service Bulletin M20-239, which references FAA AD 88-25-11. The compliance deadline (section 4) is set within 25 hours of time in service after 11 January 1989. The Act imposes specific obligations on the relevant parties, primarily the aircraft operators and maintenance personnel. Operators of the affected Mooney M20J and M20K aircraft must ensure that the required modifications or inspections are carried out as per the Mooney Aircraft Corporation Service Bulletin M20-239. This includes verifying that the baggage door inside latch meets the specified safety standards to prevent in-flight opening, a known risk that has led to accidents overseas. Maintenance personnel must be adequately trained and authorised to perform these actions, ensuring that the aircraft remains airworthy and complies with the safety directive. Failure to comply with the provisions outlined in AD/M20/44 may result in various consequences. Civil penalties can be imposed for non-compliance, which may include fines. Additionally, continued operation of an aircraft that does not meet the safety requirements could lead to enforcement actions by the Civil Aviation Safety Authority, potentially resulting in grounding of the aircraft until compliance is achieved. Such non-compliance not only poses a risk to the passengers and crew but can also result in criminal charges if it is deemed that gross negligence or willful disregard of safety regulations was involved, potentially leading to imprisonment. The maximum penalties for such offences are determined by the specific provisions of the Civil Aviation Act 1988, and may include substantial fines and imprisonment terms.
