Overview

The Civil Aviation Regulations 1998, enacted by the Parliament of Australia, form a comprehensive regulatory framework for civil aviation safety, with specific attention to the airworthiness of aircraft. One such regulation, AD/LEARJET/17 Amendment 1, addresses the installation of a cabin altitude pressure limiter in Gates Learjet 24 and 25 series aeroplanes, aiming to ensure that these aircraft meet safety standards and operate within safe pressure limits. This directive responds to a recognised gap in safety protocols by mandating the installation of this limiter within specified timeframes for certain serial numbers, thus enhancing the overall safety of these aircraft in service. The policy objective of this legislative instrument is to enhance the safety of civil aviation by ensuring that specific aircraft models are equipped with necessary safety modifications. This is achieved by specifying compliance requirements and applicable serial numbers, thereby directly addressing safety issues related to cabin pressure management in Learjet 24 and 25 series aeroplanes. The regulation is enforced by the Civil Aviation Safety Authority, ensuring that all relevant aircraft meet the stipulated safety directives to protect passengers and crew.

Scope and Application

The Civil Aviation Regulations 1998, specifically Part 39 - 105, mandate the Airworthiness Directives for Gates Learjet 24 and 25 series aeroplanes. This regulation applies to specific serial numbers of the Learjet 24 and 25 models, namely all model 24 aeroplanes with serial numbers between 24-100 and 24-349, and all model 25 aeroplanes with serial numbers between 25-003 and 25-226. The directive mandates compliance with Learjet Airplane Mod Kit AMK 78-5 or AMK 83-1 as applicable, requiring modifications within specified hours of time in service. For Learjet Airplane Mod Kit AMK 78-5, compliance is required within 600 hours of time in service after 31 January 1979, while for Learjet Airplane Mod Kit AMK 83-1, compliance must be achieved within 300 hours of time in service after 31 January 1984. This directive includes additional models and excludes certain serial numbers as per Learjet Airplane Mod Kit AMK 83-1, thereby ensuring specific aeroplanes meet the necessary safety standards. The Civil Aviation Safety Authority enforces these regulations to ensure the continued airworthiness of these aircraft within the Commonwealth of Australia.

Key Provisions

The Civil Aviation Regulations 1998, specifically Part 39 - 105, which pertains to the Civil Aviation Safety Authority Schedule of Airworthiness Directives, includes provisions for the Gates Learjet 24 & 25 Series Aeroplanes, particularly regarding the installation of a cabin altitude pressure limiter. The applicable airworthiness directive is AD/LEARJET/17 Amendment 1 (AD/LEARJET/17Amdt 1), which mandates the installation of a cabin altitude pressure limiter on certain models of Learjet aeroplanes (Section 1). The directive applies to all model 24 with serial numbers (S/Nos.) 24-100 to 24-349 and all model 25 with S/Nos. 25-003 to 25-226, excluding specific serial numbers within these ranges. The installation must be carried out according to the Learjet Airplane Modification Kit (AMK) 78-5 or AMK 83-1, as applicable. For aircraft that meet the criteria, compliance must occur within 600 hours of time in service after 31 January 1979 for AMK 78-5, and within 300 hours of time in service after 31 January 1984 for AMK 83-1 (Section 1). The Act imposes specific obligations on the operators and owners of the affected Learjet aeroplanes. These parties must ensure that the cabin altitude pressure limiter is installed within the stipulated timeframes. Operators and owners are required to follow the instructions provided in the Learjet Airplane Mod Kit AMK 78-5 or AMK 83-1 to achieve compliance. They must also keep records of the installation process and the associated maintenance logs, ensuring that the modifications are properly documented and verified by authorised personnel. These obligations ensure that the aircraft remain airworthy and meet the safety standards set forth by the Civil Aviation Safety Authority (CASA). Failure to comply with the airworthiness directive may result in various civil and criminal consequences. Under the Civil Aviation Act 1988, non-compliance with an airworthiness directive is an offence. Those found in breach may face penalties, including fines and potential prosecution. The maximum penalties for such offences can be substantial, reflecting the seriousness of maintaining aircraft airworthiness. In addition to criminal penalties, CASA may impose administrative penalties, such as suspension or revocation of the aircraft's certificate of airworthiness. These stringent measures are in place to ensure strict adherence to the safety regulations and to protect the public from potential hazards associated with non-compliant aircraft.
