Overview

The Civil Aviation Regulations 1998, specifically Part 39 - 105, encompasses the Civil Aviation Safety Authority's Schedule of Airworthiness Directives, including AD/JETSTREAM/63. Enacted in 1998, these regulations were introduced to ensure the airworthiness of aircraft operating in Australian airspace by addressing identified safety issues. This particular directive targets British Aerospace BAe 3100 (Jetstream) Series Aeroplanes, specifically addressing concerns related to the aileron control system mounting spigot nut. The problem it addresses involves reports of cracks and failures in the threaded portion of the aileron control mounting spigots, attributed to stress corrosion. The policy objective is to mandate compliance with specific service bulletins to rectify these issues, ensuring the safety of the aircraft and its occupants. This legislative instrument, created under the authority of the Civil Aviation Act 1988, aims to mitigate risks associated with identified safety hazards. It requires Jetstream Series 3100 aircraft and Jetstream 3200 aircraft up to and including constructors number 979 to take corrective action as per the Jetstream Mandatory Service Bulletin 57-JA 921140 or its revision. The directive mandates compliance by 1 January 1995, unless the required action has already been completed, underscoring the urgency and importance of addressing these structural integrity issues.

Scope and Application

The Civil Aviation Regulations 1998, specifically Part 39 - 105, apply to all Jetstream Series 3100 aircraft and all Jetstream 3200 aircraft up to and including constructors number 979. These regulations mandate compliance with Jetstream Mandatory Service Bulletin 57-JA 921140 or Service Bulletin 57-JA 921140 Revision 1 concerning the aileron control system mounting spigot nut, to address reported issues of cracks and failures in the threaded portion of the aileron control mounting spigots, which have been attributed to stress corrosion. The requirement necessitates that the action be completed unless it has already been accomplished prior to 1 January 1995. This regulation operates under the jurisdiction of the Commonwealth of Australia and extends to the national airspace, ensuring the safety and airworthiness of the specified aircraft.

Key Provisions

The Civil Aviation Regulations 1998, specifically Part 39 - 105, includes the Civil Aviation Safety Authority (CASA) Schedule of Airworthiness Directives, which outlines mandatory safety measures for certain aircraft. Among these directives, AD/JETSTREAM/63 pertains to the aileron control system mounting spigot nut for British Aerospace BAe 3100 (Jetstream) Series Aeroplanes (Section 1). This directive requires all Jetstream Series 3100 aircraft, and all Jetstream 3200 aircraft up to and including constructors number 979, to comply with either Jetstream Mandatory Service Bulletin 57-JA 921140 or its Revision 1 (Section 2). The action mandated by this directive must be completed unless already accomplished prior to 1 January 1995 (Section 3). The obligations imposed by AD/JETSTREAM/63 require aircraft operators and maintenance personnel to adhere strictly to the specified service bulletins. This involves conducting a thorough inspection and, if necessary, replacing the mounting spigot nuts of the aileron control system to prevent potential failure due to stress corrosion. The regulations mandate that these actions be completed in a timely manner to ensure the safety and airworthiness of the affected aircraft. Compliance with these directives is crucial, as it directly impacts the operational safety of the aircraft and the passengers they carry. In terms of consequences, failure to comply with the provisions of AD/JETSTREAM/63 can lead to significant civil and criminal penalties. The Civil Aviation Act 1988, under which these regulations operate, allows for enforcement actions against non-compliance. This can include fines, suspension or revocation of aircraft operating certificates, and potential criminal charges against responsible individuals. The seriousness of these consequences underscores the importance of adhering to the airworthiness directives outlined by CASA to maintain the highest standards of aviation safety.
