Overview
The Civil Aviation Regulations 1998, enacted by the Australian Parliament, serve to regulate the safety and airworthiness of aircraft within Australian airspace. Specifically, Part 39 - 105, which pertains to the Civil Aviation Safety Authority Schedule of Airworthiness Directives, was introduced to ensure that aircraft maintain the highest safety standards. The amendment to the British Aerospace BAe 3100 (Jetstream) Series Aeroplanes AD/JETSTREAM/40, Amendment 1, addresses a reported issue with the nose landing gear top cap assembly. This directive aims to ensure that the specified Jetstream models comply with the latest mandatory service bulletins to prevent failures in the top cap bolts of the nose landing gear, thus maintaining the safety and airworthiness of these aircraft. The amendment is effective from 12 October 1995, following the issuance of the latest revision of the Requirement Document and the associated AP Precision Hydraulics Service Bulletin 32-41 Revision 3.
Scope and Application
The Civil Aviation Regulations 1998, specifically Part 39 - 105, applies to the British Aerospace BAe 3100 (Jetstream) Series Aeroplanes through Airworthiness Directives (AD) issued by the Civil Aviation Safety Authority (CASA). This legislation applies to specific models of Jetstream aircraft, namely the HP137 Mk1, Jetstream Series 200 and 3100, and Jetstream Series 3200 with constructors' numbers ranging from 790 through 854. The directive also pertains to these aircraft models with specified modification status and installed nose gear types, as detailed in the Requirement Document. Compliance with this AD is mandatory and requires adherence to the latest revision of the Jetstream Mandatory Service Bulletin 32-JA 901040 Revision 3. The AD's applicability is strictly within the Commonwealth of Australia, governed by CASA, and no exclusions or exemptions are mentioned within the scope of this directive. The directive extends its reach to ensure safety and airworthiness compliance through subordinate instruments, thereby enforcing necessary modifications to address reported failures of nose landing gear top cap bolts.
Key Provisions
The Civil Aviation Regulations 1998, Part 39 - 105, specifically in the context of the Civil Aviation Safety Authority Schedule of Airworthiness Directives, addresses the maintenance and safety requirements for certain aircraft types. Within this, AD/JETSTREAM/40 Amendment 1, pertaining to the British Aerospace BAe 3100 (Jetstream) Series Aeroplanes, mandates actions to ensure the safety of specific aircraft models (s. 1). The directive applies to the Model HP137 Mk1, Jetstream Series 200 and Jetstream Series 3100 Aircraft, as well as Jetstream Series 3200 Aircraft with particular constructor numbers and specific nose gear types (s. 2). The requirement for compliance is based on the Jetstream Mandatory Service Bulletin 32-JA 901040 Revision 3, which outlines the necessary actions to address the reported failures of top cap bolts in the nose landing gear (s. 3).
The Civil Aviation Regulations impose several obligations on the parties or entities governed by this directive. Firstly, operators of the specified Jetstream aircraft models must ensure that the action specified in the Jetstream Mandatory Service Bulletin 32-JA 901040 Revision 3 is carried out in accordance with the requirements set out in the Requirement Document (s. 3). This involves detailed inspections and potentially the replacement or repair of the top cap assembly of the nose landing gear, as directed. Compliance with this directive is essential to maintain the airworthiness of these aircraft and ensure the safety of all passengers and crew.
Failure to comply with the provisions of this Airworthiness Directive can result in significant consequences. The regulations impose both civil and criminal penalties for non-compliance. Civil penalties may include fines and enforcement actions taken by the Civil Aviation Safety Authority. Criminal penalties may apply in cases of gross negligence or willful disregard of the safety regulations, potentially leading to substantial fines and imprisonment. The maximum penalties are not explicitly stated in the provided text, but they can be severe, reflecting the critical nature of ensuring aircraft safety. Operators found in breach of these regulations could face significant financial and reputational consequences, alongside potential criminal charges for those responsible for gross negligence or willful non-compliance.
