Overview

The Civil Aviation Regulations 1998, enacted by the Commonwealth of Australia, serve to regulate various aspects of civil aviation safety within the country. Among its many parts, Part 39 - 107 pertains to the Civil Aviation Safety Authority's schedule of airworthiness directives, which are legally binding instructions issued to ensure the safe operation of aircraft. The aim of these regulations is to address specific safety concerns and ensure that aircraft remain in a safe and airworthy condition throughout their operational life. This particular legislative instrument, AD/INST/23Amdt 1, focuses on the Edo-Aire Mitchell NSD-360 Compass System, specifically addressing the addition of a Nav Flag Adapter for certain compass systems to ensure continued compliance with safety standards. The instrument was enacted to address safety concerns related to the compass systems used in certain aircraft, particularly those employing Edo-Aire Mitchell NSD-360 Compass Systems and specific navigation instrument part numbers. The regulations mandate compliance within 100 hours of the aircraft being in service after 31 January 1978, ensuring that any necessary modifications are made to maintain the airworthiness of the aircraft. This legislative measure is part of a broader effort by the Civil Aviation Safety Authority to maintain high safety standards in the aviation industry, ensuring the safety of both passengers and crew.

Scope and Application

The Civil Aviation Regulations 1998, specifically Part 39 - 107, applies to the Civil Aviation Safety Authority’s Schedule of Airworthiness Directives, which mandates compliance with particular safety directives for airworthiness in Australia. This regulation pertains to NSD-360 Compass Systems that use VOR/Localiser Converters of specific types excluding Edo-Aire Mitchell AK423, IC707, or IC707-1, and certain navigation instruments identified by particular part numbers. The requirement to comply with these directives applies within 100 hours of time in service following 31 January 1978. The scope of the regulation is national, encompassing all aircraft operating within Australia that fall under the specified parameters. The regulation does not specify any exclusions or exemptions within the provided text, indicating that all applicable aircraft and systems must adhere to the directives unless otherwise noted in subordinate instruments or further clarifications.

Key Provisions

The Civil Aviation Regulations 1998, specifically in Part 39 - 107 (1), mandate the addition of a Nav Flag Adapter to the Edo-Aire Mitchell NSD-360 Compass System for certain aircraft. This applies to NSD-360 Compass Systems that are using VOR/Localiser Converters other than the Edo-Aire Mitchell types AK423, IC707, or IC707-1, and specific navigation instrument part numbers (2). Compliance with this directive must occur within 100 hours of time in service after 31 January 1978, or if the aircraft previously complied with an earlier issue of this directive, it is considered compliant with the current one (3). The Act imposes specific obligations on aircraft owners and operators, requiring them to ensure that the compass system modifications are made in accordance with the specified service bulletins or manufacturer's instructions. The relevant service bulletins include Edo-Aire Mitchell SB No. MB-13, Piper SB Nos. 565, 566, or 600-63, and any other manufacturer service bulletins referencing Edo-Aire Mitchell SB No. MB-13 (4). Aircraft owners and operators must keep records of compliance and ensure that the modifications are performed by authorised personnel. Failure to comply with these directives can lead to enforcement actions under the Civil Aviation Act 1988. Non-compliance may result in penalties, including fines and potential grounding of the aircraft until the required modifications are made. The specific penalties for non-compliance are not detailed in the legislative instrument but can be substantial under Australian aviation law, reflecting the importance of adhering to airworthiness directives for the safety of air travel (5).
