COMMONWEALTH OF AUSTRALIA (Civil Aviation Regulations 1998), PART 39 - 105 CIVIL AVIATION SAFETY AUTHORITY
SCHEDULE OF AIRWORTHINESS DIRECTIVES
AIRWORTHINESS DIRECTIVE
For the reasons set out in the background section, the CASA delegate whose signature appears below issues the following Airworthiness Directive (AD) under subregulation 39.1 (1) of CAR 1998. The AD requires that the action set out in the requirement section (being action that the delegate considers necessary to correct the unsafe condition) be taken in relation to the aircraft or aeronautical product mentioned in the applicability section: (a) in the circumstances mentioned in the requirement section; and (b) in accordance with the instructions set out in the requirement section; and (c) at the time mentioned in the compliance section.
McDonnell Douglas (Hughes) 369 and Kawasaki 369 Series Helicopters
AD/HU 369/110 Rescue Hoist 13/2002 DM
Applicability: Model MD-500 helicopters equipped with a Breeze Eastern Aerospace rescue hoist series BL-16600, excluding BL-16600-160.
Requirement: Perform a one-time inspection of the rescue hoist mounting bracket in accordance with Breeze Eastern Customer Aerospace Advisory Bulletin CAB-100-56, dated 11 November 1997.
Note: FAA AD 2002-20-05 Amdt 39-12901 refers.
Compliance: Before the next usage of the rescue hoist after 6 November 2002, unless already accomplished.
This Airworthiness Directive becomes effective on 6 November 2002.
Background: The FAA received reports of cracked rescue hoist mounting brackets. Such cracking could result in mounting bracket failure and separation of the rescue hoist from the helicopter.
David Alan Villiers
Delegate of the Civil Aviation Safety Authority 1 November 2002
The above AD is notified in the Commonwealth of Australia Gazette on 6 November 2002.
Overview
The Civil Aviation Regulations 1998, enacted in 1998, serve as the primary regulatory framework for civil aviation safety in Australia, ensuring that all aircraft and aeronautical products meet the required safety standards. The Civil Aviation Safety Authority (CASA) issues Airworthiness Directives under subregulation 39.1 (1) of CAR 1998 to address specific safety concerns that may arise in the aviation industry. The directive aims to rectify unsafe conditions by mandating necessary actions to maintain the airworthiness of aircraft and aeronautical products. This particular Airworthiness Directive AD/HU 369/110, issued on 6 November 2002, targets a specific safety issue with McDonnell Douglas (Hughes) 369 and Kawasaki 369 Series Helicopters, requiring a one-time inspection of the rescue hoist mounting bracket to prevent potential failures that could endanger flight safety.
Scope and Application
The Airworthiness Directive (AD) set out in the Civil Aviation Regulations 1998 applies specifically to McDonnell Douglas (Hughes) 369 and Kawasaki 369 Series Helicopters that are equipped with a Breeze Eastern Aerospace rescue hoist series BL-16600, excluding BL-16600-160. This AD mandates a one-time inspection of the rescue hoist mounting bracket in accordance with Breeze Eastern Customer Aerospace Advisory Bulletin CAB-100-56, dated 11 November 1997. The directive, issued by a delegate of the Civil Aviation Safety Authority (CASA), becomes effective on 6 November 2002, and requires the inspection to be completed before the next usage of the rescue hoist after this date, unless it has already been performed. The directive applies across the Commonwealth of Australia and is published in the Commonwealth of Australia Gazette, ensuring that all relevant stakeholders are duly informed and compliant with the safety requirements.
Key Provisions
The Civil Aviation Regulations 1998, specifically under Part 39 - 105, establish a framework for the issuance of Airworthiness Directives (ADs) by the Civil Aviation Safety Authority (CASA). Section 39.1(1) allows CASA to issue ADs to ensure the airworthiness of aircraft and aeronautical products. The AD in question, AD/HU 369/110, pertains to the McDonnell Douglas (Hughes) 369 and Kawasaki 369 Series Helicopters. It mandates a one-time inspection of the rescue hoist mounting bracket for MD-500 helicopters equipped with a specific model of Breeze Eastern Aerospace rescue hoist, as outlined in the requirement section (AD/HU 369/110). The inspection must be conducted according to the instructions provided in Breeze Eastern Customer Aerospace Advisory Bulletin CAB-100-56 dated 11 November 1997. The directive becomes effective on 6 November 2002, and compliance must be achieved before the next usage of the rescue hoist following that date.
Under the obligations set forth by this AD, operators of the specified helicopters must ensure that the one-time inspection of the rescue hoist mounting bracket is carried out in accordance with the detailed instructions in CAB-100-56. This inspection is necessary to address the potential risk of cracked mounting brackets, which could lead to catastrophic failure and separation of the hoist from the helicopter. The AD underscores the importance of timely compliance to maintain the safety standards of the aircraft. Operators are also required to reference FAA AD 2002-20-05 Amdt 39-12901, which is related to the directive.
Failure to comply with the AD may result in serious safety implications, although the specific civil or criminal consequences are not detailed within the directive itself. However, non-compliance with ADs generally could lead to enforcement actions by CASA, which may include fines, suspension, or revocation of the aircraft's airworthiness certificate. The potential penalties are significant and underscore the critical nature of adhering to safety directives. The AD itself does not specify maximum penalties, but such measures are typically outlined in broader aviation safety regulations.
