Overview

The Civil Aviation Regulations 1998, under Part 39 - 105, outlines specific airworthiness directives to ensure the safety of aviation operations. One such directive is AD/HU 269/82 Amendment 1, which pertains to the Schweizer (Hughes) 269 Series Helicopters, particularly those equipped with P/No. 269A1290-1 elastomeric dampers. This legislation was enacted to address issues arising from moisture and contaminants infiltrating the elastomeric damper assemblies, leading to bun separation and corrosion. The objective of this directive is to mandate compliance with Schweizer S.I.N. No. N-201-1, ensuring timely actions to maintain the airworthiness of the helicopters. The directive was introduced by the Civil Aviation Safety Authority to uphold stringent safety standards in the aviation industry. The policy objective of this directive is to mitigate risks associated with the degradation of the elastomeric dampers in Schweizer (Hughes) 269 Series Helicopters, thereby enhancing overall aviation safety. The requirement necessitates adherence to specific timelines for compliance, with Part I mandating action within 300 hours of time in service after 31 December 1986, and Part II requiring compliance whenever adjustments to the elastomeric dampers are performed. This legislative instrument was formulated by the Civil Aviation Safety Authority to ensure that all relevant stakeholders are aware of and comply with these safety standards to prevent potential hazards.

Scope and Application

The Civil Aviation Regulations 1998, specifically under Part 39, applies to all Schweizer (Hughes) 269 Series Helicopters fitted with P/No. 269A1290-1 elastomeric dampers. This regulation is enacted under the authority of the Civil Aviation Safety Authority and is intended to ensure the airworthiness of these helicopters by addressing potential issues with the main rotor blade's elastomeric dampers. The geographic and jurisdictional reach of this regulation is national, applying across all states and territories of Australia. The primary concern addressed by this directive is the ingress of moisture and contaminants into the elastomeric damper assemblies, which can lead to bun separation and corrosion. This poses a significant safety risk, hence the mandate for compliance with Schweizer S.I.N. No. N-201-1. The compliance requirements include adherence to Part I of the Requirement Document within 300 hours of time in service after 31 December 1986, and Part II of the Requirement Document whenever any time adjustment of the elastomeric damper is carried out. The regulation does not specify any exclusions, exemptions, or thresholds, and its application is extended through the subordinate instrument Schweizer S.I.N. No. N-201-1, which provides detailed procedural guidance for compliance.

Key Provisions

The Civil Aviation Regulations 1998, specifically under PART 39 - 105, mandates the Civil Aviation Safety Authority to issue airworthiness directives for various aircraft types, including the Schweizer (Hughes) 269 Series Helicopters. Section AD/HU 269/82 Amendment 1 pertains to the main rotor blade elastomeric dampers, and it requires all 269 Series Helicopters equipped with P/No. 269A1290-1 elastomeric dampers to comply with Schweizer S.I.N. No. N-201-1. This requirement is intended to address issues where moisture and contaminants have infiltrated the elastomeric damper assemblies, leading to bun separation and corrosion. The obligations imposed by this directive are straightforward yet crucial for ensuring the continued airworthiness of the affected helicopters. Operators of these helicopters must ensure that Part I of the Requirement Document is adhered to within 300 hours of time in service after 31 December 1986. Furthermore, Part II requires that any adjustments to the elastomeric dampers be performed according to the latest amendments to the Requirement Document, which include a change in the type of sealant used. Compliance with these provisions is essential to maintain the structural integrity of the main rotor blade dampers and to prevent potential safety hazards. Failure to comply with the airworthiness directives can result in significant consequences. The Civil Aviation Regulations 1998 outline both civil and criminal penalties for non-compliance with airworthiness directives. Civil penalties may include fines, while criminal penalties can lead to imprisonment. The exact penalties depend on the severity of the non-compliance and are subject to the provisions of the Civil Aviation Act 1988. Additionally, non-compliance with airworthiness directives can lead to the grounding of the affected aircraft, which can have severe operational and financial implications for the operators. Overall, the key provisions of the Civil Aviation Regulations 1998, as detailed in PART 39 - 105, mandate specific actions to be taken by operators of Schweizer (Hughes) 269 Series Helicopters to address issues with the main rotor blade elastomeric dampers. These actions include adherence to the latest amendments of Schweizer S.I.N. No. N-201-1 and ensuring that all adjustments are performed correctly. Failure to comply with these directives can result in both civil and criminal penalties, as well as operational disruptions due to the grounding of the affected aircraft.
