COMMONWEALTH OF AUSTRALIA (Civil Aviation Regulations 1998), PART 39 - 105 CIVIL AVIATION SAFETY AUTHORITY
SCHEDULE OF AIRWORTHINESS DIRECTIVES
AIRWORTHINESS DIRECTIVE
For the reasons set out in the background section, the CASA delegate whose signature appears below revokes Airworthiness Directive (AD) AD/HS 748/20 and issues the following AD under subregulation 39.1 (1) of CAR 1998. The AD requires that the action set out in the requirement section (being action that the delegate considers necessary to correct the unsafe condition) be taken in relation to the aircraft or aeronautical product mentioned in the applicability section: (a) in the circumstances mentioned in the requirement section; and (b) in accordance with the instructions set out in the requirement section; and (c) at the time mentioned in the compliance section.
British Aerospace (Hawker Siddeley) HS 748 Series Aeroplanes
AD/HS 748/20
Amdt 1
Rear Pressure Bulkhead and Fin Attachment Fittings
8/2001
Applicability: All HS 748 aircraft.
Requirement: Inspect in accordance with BAE Systems Mandatory Service Bulletin HS748-53-49 Revision 2.
Note 1: UK CAA AD 002-03-83 refers.
Note 2: The inspection of certain fuselage fin attachment fittings are required by AD/HS 748/19.
Compliance: As specified in the Approval part of the Requirement document.
This Airworthiness Directive becomes effective on 9 August 2001.
Background: A structural audit carried out by British Aerospace indicated that the fin attachment fittings require regular inspections to ensure the continuing airworthiness of the HS 748 aircraft.
Amendment 1 is issued in response to a revision of the Requirement document, which introduces the requirement to inspect other areas for fatigue damage while the fin is removed, and also to replace a number of items and return them to BAE Systems Regional Aircraft for detailed examination. Additionally, the revision provides clarification to repeat inspection instructions and the eddy current technique.
David Alan Villiers
Delegate of the Civil Aviation Safety Authority 3 July 2001
The above AD is notified in the Commonwealth of Australia Gazette on 11 July 2001.

Overview
The Civil Aviation Regulations 1998, enacted by the Parliament of Australia, form a comprehensive regulatory framework designed to ensure the safety and efficiency of civil aviation in Australia. The Civil Aviation Safety Authority (CASA) administers these regulations and issues airworthiness directives to address identified safety issues. One such directive, AD/HS 748/20 Amendment 1, was issued on 8 August 2001, targeting all British Aerospace (Hawker Siddeley) HS 748 Series Aeroplanes. This directive mandates specific inspections and actions to address potential unsafe conditions related to the rear pressure bulkhead and fin attachment fittings, as highlighted by a structural audit conducted by British Aerospace. The policy objective of this directive is to ensure the continuing airworthiness of the HS 748 aircraft through regular inspections and necessary repairs, thereby mitigating potential safety risks.
Scope and Application
The Civil Aviation Regulations 1998, specifically under PART 39 - 105, governs the airworthiness of aircraft in Australia, with the Civil Aviation Safety Authority (CASA) acting as the regulatory body. The Airworthiness Directive (AD) in question applies to all British Aerospace (Hawker Siddeley) HS 748 Series Aeroplanes, mandating specific inspections and actions to ensure ongoing compliance with airworthiness standards. This directive, issued by a CASA delegate, revokes a previous directive and introduces new requirements, including the inspection of rear pressure bulkhead and fin attachment fittings in accordance with a specified service bulletin. The AD outlines precise requirements, noting relevant UK Civil Aviation Authority directives and specifying compliance timelines and inspection techniques. Exemptions or exclusions are not mentioned in this directive, implying that all applicable aircraft must adhere to the outlined measures. The AD extends its reach nationally, applying to all relevant aircraft within Australia, and its applicability is enforced through subordinate instruments and regulatory notifications.
Key Provisions
The key provision of the Airworthiness Directive (AD) AD/HS 748/20, as amended by Amendment 1, pertains to the inspection and maintenance of specific components of the British Aerospace (Hawker Siddeley) HS 748 Series Aeroplanes (section 1). The AD mandates that all HS 748 aircraft must undergo an inspection of the rear pressure bulkhead and fin attachment fittings in accordance with BAE Systems Mandatory Service Bulletin HS748-53-49 Revision 2 (section 2). This inspection is necessary to ensure the continuing airworthiness of the aircraft, as indicated by a structural audit by British Aerospace. The compliance timeline is specified within the approval part of the requirement document (section 3).
This AD imposes specific obligations on the operators of HS 748 aircraft. They must ensure that the required inspections are conducted by certified personnel following the instructions provided in the BAE Systems Mandatory Service Bulletin HS748-53-49 Revision 2. The AD also mandates that any identified issues must be addressed promptly to maintain the aircraft’s airworthiness. Additionally, operators must comply with the UK CAA AD 002-03-83 and the inspection requirements outlined in AD/HS 748/19.
Failure to comply with the AD can result in serious consequences. The AD is issued under the authority of the Civil Aviation Safety Authority (CASA) and is legally binding. Non-compliance with the AD may result in the aircraft being grounded until the required inspections and repairs are completed. There are no specific criminal or civil penalties mentioned in the text, but non-compliance could lead to enforcement actions by CASA, including fines, operational restrictions, or other regulatory measures to ensure compliance with aviation safety standards.
