2. Rectify, if required, within 60 days of the Requirement 1 inspection.

Background: An in-service failure of an eye bolt revealed the possibility of incorrect bedding of the eye bolt head to the sub-frame “Y” plate.

Overview

The Civil Aviation Regulations 1998, specifically PART 39 - 105 CIVIL AVIATION SAFETY AUTHORITY SCHEDULE OF AIRWORTHINESS DIRECTIVES, introduced AD/HS 748/17 to address the potential safety risks associated with the eye bolt installation in the British Aerospace (Hawker Siddeley) HS 748 Series Aeroplanes. This directive was enacted by the Civil Aviation Safety Authority, with the primary objective of ensuring the safety of aircraft operations by rectifying any deficiencies in the eye bolt installations that could lead to structural failures. The directive was issued in response to an in-service failure of an eye bolt, which highlighted the risk of improper bedding of the eye bolt head to the sub-frame “Y” plate. This legislative instrument requires operators of HS 748 aircraft to inspect the installation of the eye bolt into the “Y” plate in accordance with British Aerospace Mandatory Service Bulletin 54/31. Any deficiencies identified during the inspection must be rectified within a specified timeframe to maintain compliance with the regulations and to ensure the continued airworthiness of the aircraft. The directive references UK Civil Aviation Authority AD 009-08-88, indicating a collaborative approach to safety standards between Australian and UK aviation authorities.

Scope and Application

The Civil Aviation Regulations 1998, specifically under Part 39 - 105 and the Civil Aviation Safety Authority (CASA) Schedule of Airworthiness Directives, applies to all British Aerospace (Hawker Siddeley) HS 748 Series aeroplanes, ensuring the safety and airworthiness of these aircraft within the Australian airspace. This regulation mandates inspections and necessary rectifications of the engine subframe eye bolt installation to prevent potential failures that could compromise flight safety. The directive encompasses both left and right engine subframe assemblies and requires adherence to British Aerospace Mandatory Service Bulletin (MSB) 54/31 for the inspection and any required corrective actions. Non-compliance with the inspection deadline of 11 May 1995 and the rectification period of 60 days post-inspection could lead to operational restrictions until the deficiencies are addressed. The regulation extends to all HS748 aircraft operating within Australian jurisdiction, ensuring uniform safety standards are upheld regardless of the operator. The directive’s scope is comprehensive, targeting a specific part of the aircraft that has been identified as critical to overall safety. Any deviations from the stipulated procedures or timelines may result in significant safety risks, necessitating strict adherence to the CASA guidelines. The regulation’s application is enforced nationally, ensuring that all HS748 aircraft within Australia meet the specified airworthiness criteria.

Key Provisions

The key operative sections of the Civil Aviation Regulations 1998, specifically AD/HS 748/17, mandate specific inspections and rectifications for the British Aerospace (Hawker Siddeley) HS 748 Series Aeroplanes. Section 1 requires that all HS748 aircraft must have the installation of the eye bolt (P/N 14b.0.3975) into the “Y” plate (P/N 14a.0.3975) inspected. This inspection must be carried out in accordance with British Aerospace Mandatory Service Bulletin (MSB) 54/31 (section 1(1)). If any deficiencies in the eye bolt installation are found, they must be rectified in accordance with the same service bulletin (section 1(2)). These obligations are imposed on all owners and operators of HS748 aircraft. They must ensure that the inspections are carried out before 11 May 1995 (section 1(1)(a)) and that any necessary rectifications are completed within 60 days of the initial inspection (section 1(2)(a)). The purpose of these requirements is to address the potential for incorrect bedding of the eye bolt head to the sub-frame “Y” plate, as evidenced by an in-service failure (section 2). Failure to comply with these directives can result in significant legal consequences. Although the specific penalties are not detailed in the legislative instrument, non-compliance with Civil Aviation Regulations can generally lead to enforcement actions by the Civil Aviation Safety Authority. These actions may include fines, operational restrictions, or even the grounding of non-compliant aircraft. The severity of these penalties can vary depending on the nature and extent of the non-compliance.
