Overview

The Civil Aviation Regulations 1998, specifically Part 39 - 105 concerning the Civil Aviation Safety Authority's Schedule of Airworthiness Directives, address the safety standards and operational requirements for aircraft in Australia. One of the amendments, AD/GROB 115/7 Amendment 2, pertains to the Grob G115 Series Aeroplanes, including models G115C, G115C2, G115D, and G115D2 across all serial numbers. This legislative instrument was introduced to address the safety concerns identified during an investigation into an incident of buffeting that occurred when an aircraft approached its never exceed speed. The investigation found that the buffeting was caused by a vibration in the aircraft structure, originating from the engine shock mounts. The primary objective of this amendment is to ensure compliance with the updated airworthiness directives by requiring action in accordance with the Grob Service Bulletin 1078-69, particularly in light of the cancellation of a previously required airspeed limitation following the successful completion of the buffeting investigation. Compliance with this amendment is mandatory unless already accomplished, and it must be addressed before the next flight following 26 March 1998.

Scope and Application

The Civil Aviation Regulations 1998, specifically Part 39 - 105, pertains to the Civil Aviation Safety Authority's Schedule of Airworthiness Directives, which includes detailed guidelines for maintaining the airworthiness of aircraft. This particular legislation, AD/GROB 115/7 Amendment 2, applies to all models of the Grob G115 series aeroplanes, including G115C, G115C2, G115D, and G115D2, regardless of their serial numbers. The directive mandates compliance with the instructions outlined in Grob Service Bulletin 1078-69, which was issued in response to a structural vibration identified during an incident where buffeting occurred as the aircraft approached its never exceed speed. The directive requires that certain actions be taken, particularly those relating to the previously established airspeed limitations, which have been revised following a successful buffeting investigation. Compliance with this amendment is mandatory unless the required actions have already been performed, and must be completed before the next flight after 26 March 1998. The directive is applicable nationally, under the Commonwealth of Australia, and its scope is extended or restricted by subordinate instruments as necessary.

Key Provisions

The Civil Aviation Regulations 1998, specifically Part 39 - 105, mandates certain actions to ensure the airworthiness of Grob G115 Series Aeroplanes. Section 39-105 of the AD/GROB 115/7 Amendment 2 requires compliance with Grob Service Bulletin 1078-69, which pertains to the cancellation of the previously mandated reduction of the never exceed speed. This amendment applies to all models of the Grob G115 series, including G115C, G115C2, G115D, and G115D2, regardless of serial number. The requirement is to complete the specified action before the next flight following 26 March 1998. This amendment became effective on the same date. The obligations imposed by this directive require aircraft operators to adhere to the service bulletin and ensure that the specified action is completed before the stipulated date. This involves inspecting and potentially modifying the aircraft to ensure it complies with the updated airworthiness standards. The directive references LBA AD 96-270/3, indicating that operators should be aware of and follow related safety directives issued by the German Federal Aviation Office (LBA). Failure to comply with this airworthiness directive can result in significant legal consequences. Civil Aviation Regulations 1998 impose strict penalties for non-compliance, including fines and potential grounding of the aircraft. The severity of the penalty depends on the nature and extent of the non-compliance, but operators can expect enforcement actions from the Civil Aviation Safety Authority (CASA). In extreme cases, non-compliance may lead to criminal charges, especially if it is found that the non-compliance contributed to an aviation incident or accident. The potential penalties underscore the importance of adhering to the specified requirements to maintain the safety and airworthiness of the aircraft.
