COMMONWEALTH OF AUSTRALIA (Civil Aviation Regulations 1998), PART 39 - 105 CIVIL AVIATION SAFETY AUTHORITY
SCHEDULE OF AIRWORTHINESS DIRECTIVES
GAF N22 and N24 Series Aeroplanes
AD/GAF-N22/45 Revised Compliance Requirements for
Embodiment of Nomad Service Bulletins NMD-27-9 and NMD-27-15
6/82
Applicability: All Nomad Model N22 and N22B landplanes not incorporating Modifications N211 and N63.
Requirement: 1. Nomad Alert Service Bulletin ANMD-27-25.
2. Upon receipt of this AD. the following placard with minimum 0.635 cm (1/4 inch) lettering shall be affixed in clear view of the pilot:-
“UNTIL INCORPORATION OF MOD N211 (SB NMD-27-9) AND MOD N63 (SB NMD-27-15), AFT CG LIMIT IS 35% MAC”.
Compliance: 1. Within 100 hours time in service after receipt of Mod. Kits but not later than 30 June 1982.
2. Immediate upon receipt of this AD.
Background: Incidents have been reported on aircraft incorporating Mod. N439, where with severe turbulence and C.G. near the aft limit, control difficulties have been experienced.
Incorporation of Mod. N211 alleviates this problem.
Overview
The Civil Aviation Regulations 1998, specifically Part 39 - 105, includes Airworthiness Directives governing the safety and airworthiness of aircraft, such as the AD/GAF-N22/45 concerning Nomad Model N22 and N22B landplanes. This directive was enacted by the Civil Aviation Safety Authority, aiming to address safety concerns arising from incidents involving severe turbulence and control difficulties when the centre of gravity was near the aft limit, particularly in aircraft incorporating Modification N439. The primary policy objective of this directive is to ensure that all applicable aircraft incorporate the necessary modifications to prevent these issues, thereby enhancing overall flight safety. The directive mandates specific compliance actions, such as the incorporation of Nomad Alert Service Bulletin ANMD-27-25 and the affixation of a clear placard indicating the aft centre of gravity limit until the required modifications are made.
The directive requires compliance within 100 hours of service time after receiving the modification kits, but not later than 30 June 1982, and immediate action upon receipt of the directive. This legislative measure underscores the importance of timely and precise adherence to safety standards in civil aviation, ensuring that aircraft remain airworthy and safe for operation.
Scope and Application
The Civil Aviation Regulations 1998, specifically Part 39 - 105, govern the application of the Civil Aviation Safety Authority’s Airworthiness Directives concerning the Nomad N22 and N22B series aeroplanes. This legislation mandates compliance with the revised requirements outlined in Nomad Alert Service Bulletin ANMD-27-25, which addresses issues related to the incorporation of Modifications N211 and N63. The directive applies to all Nomad Model N22 and N22B landplanes that do not yet incorporate the specified modifications. Operators of these aircraft are required to affix a placard with specific lettering as indicated in the directive, to ensure the pilot is clearly informed of the aircraft’s aft Centre of Gravity limit until the required modifications are implemented. Compliance with these directives is mandatory within a specified timeframe, ensuring that the aircraft maintain the highest safety standards. The scope of this regulation is jurisdictional under the Commonwealth of Australia, impacting all relevant entities operating within its airspace.
Key Provisions
The Civil Aviation Regulations 1998, particularly Part 39 - 105, mandates specific compliance requirements for Nomad Model N22 and N22B landplanes that do not include Modifications N211 and N63. Section 39.105(1) outlines the necessity for compliance with Nomad Alert Service Bulletin ANMD-27-25. Furthermore, it requires the affixing of a specific placard in clear view of the pilot, with a minimum letter size of 0.635 cm (1/4 inch), stating "UNTIL INCORPORATION OF MOD N211 (SB NMD-27-9) AND MOD N63 (SB NMD-27-15), AFT CG LIMIT IS 35% MAC". This requirement is intended to address control difficulties experienced under severe turbulence and near the aft limit of the centre of gravity (C.G.).
The obligations imposed on the parties governed by these regulations are clear and specific. Operators of the affected aircraft must ensure that they receive and adhere to the Nomad Alert Service Bulletin ANMD-27-25. Additionally, they must promptly affix the required placard upon receipt of the Airworthiness Directive (AD). Compliance with these directives must be achieved within 100 hours of time in service after receipt of the modification kits but no later than 30 June 1982. Immediate compliance is also mandated upon receiving the AD, ensuring that pilots are immediately informed of the aft C.G. limit.
Failure to comply with these provisions may result in significant consequences. The regulations stipulate that non-compliance with Airworthiness Directives can lead to various penalties. While specific penalties are not detailed in the provided text, non-compliance with civil aviation safety regulations generally can result in substantial fines and potential criminal charges. The severity of penalties may vary based on the degree of non-compliance and any resultant safety incidents or hazards. Operators are expected to strictly adhere to these directives to avoid any legal repercussions and to ensure the safety and airworthiness of the aircraft.
