COMMONWEALTH OF AUSTRALIA (Civil Aviation Regulations 1998), PART 39 - 105 CIVIL AVIATION SAFETY AUTHORITY

SCHEDULE OF AIRWORTHINESS DIRECTIVES

AIRWORTHINESS DIRECTIVE

For the reasons set out in the background section, the CASA delegate whose signature appears below issues the following Airworthiness Directive (AD) under subregulation 39.1 (1) of CAR 1998. The AD requires that the action set out in the requirement section (being action that the delegate considers necessary to correct the unsafe condition) be taken in relation to the aircraft or aeronautical product mentioned in the applicability section: (a) in the circumstances mentioned in the requirement section; and (b) in accordance with the instructions set out in the requirement section; and (c) at the time mentioned in the compliance section.

Gippsland Aeronautics GA8 Series Aeroplanes

AD/GA8/1 Aircraft Flight Manual Amendment 2/2003

Applicability: All models with S/Nos. 8-00-004 to 8-02-021.

Requirement: Replace the existing GA8 Aircraft Flight Manual, C01-01-01, pages ii, iii, and 6-7/6- 8 with CASA approved pages ii and iii dated 3 Dec 2002 and non-CASA approved pages 6-7/6-8 dated 3 Dec 2002.

Compliance: If not already accomplished, before further flight, after the Directive becomes effective.

This Airworthiness Directive becomes effective on 20 February 2003.

Background: The manufacturer/Type Certificate holder has advised that the GA8 loading trim sheets in the non-CASA approved section of the approved flight manual have been constructed with an incorrect fuel moment arm.

Overview

The Civil Aviation Regulations 1998, amended in 2003, introduced a specific Airworthiness Directive (AD) targeting the Gippsland Aeronautics GA8 Series Aeroplanes. This legislation was enacted to address an unsafe condition identified in the aircraft's flight manual, specifically the incorrect fuel moment arm on the loading trim sheets. The AD was issued by the Civil Aviation Safety Authority (CASA) under subregulation 39.1 (1) of the Civil Aviation Regulations 1998, aiming to ensure the safety of aircraft operations by mandating corrective action. The policy objective behind this directive was to rectify the identified safety issue and prevent potential hazards during flight operations, thereby enhancing overall aviation safety. The Airworthiness Directive AD/GA8/1 required the replacement of certain pages in the existing GA8 Aircraft Flight Manual with CASA-approved versions to correct the inaccuracies. The directive applied to all models with serial numbers ranging from 8-00-004 to 8-02-021, and mandated that the specified changes be implemented before further flight, following the directive's effective date of 20 February 2003. This action was taken to ensure that the aircraft met the necessary safety standards, aligning with CASA's commitment to maintaining high safety benchmarks in civil aviation.

Scope and Application

The Civil Aviation Regulations 1998, specifically Part 39 - 105, establishes the framework for the issuance of Airworthiness Directives by the Civil Aviation Safety Authority (CASA) to address safety concerns within the aviation industry. These regulations apply to all aircraft and aeronautical products within the Commonwealth of Australia and ensure compliance with safety standards set forth by CASA. The scope of this particular Airworthiness Directive, AD/GA8/1, is limited to Gippsland Aeronautics GA8 Series Aeroplanes with serial numbers ranging from 8-00-004 to 8-02-021. The directive mandates the replacement of specific pages of the GA8 Aircraft Flight Manual to correct an error in the fuel moment arm calculation, ensuring the safety of the aircraft in operation. Compliance with this directive is mandatory, with an effective date set for 20 February 2003, meaning the required actions must be completed before further flights after this date. The directive was issued by a CASA delegate and was subsequently notified in the Commonwealth of Australia Gazette on 29 January 2003.

Key Provisions

The main operative sections of this Airworthiness Directive (AD) are clearly outlined. Specifically, section (a) identifies the applicability of the directive to all Gippsland Aeronautics GA8 Series Aeroplanes with serial numbers ranging from 8-00-004 to 8-02-021. Section (b) details the requirement, which is the replacement of specific pages of the GA8 Aircraft Flight Manual. More precisely, it mandates the replacement of pages ii, iii, and 6-7/6-8 of the manual with CASA approved pages dated 3 December 2002. Section (c) establishes the compliance timeline, indicating that the specified actions must be completed before further flight once the directive becomes effective. The obligations imposed by this AD are quite straightforward. Operators of the affected aircraft must ensure that the necessary changes to the Aircraft Flight Manual are made before any further flights. This includes replacing the specified pages with the approved versions provided. The directive is clear that compliance must be achieved before the aircraft is flown again, and it is effective from 20 February 2003. This requirement ensures that the unsafe condition identified—in this case, an incorrect fuel moment arm in the loading trim sheets—is corrected, thereby enhancing flight safety. In terms of legal consequences, the AD does not explicitly mention offences, penalties, or civil/criminal consequences for non-compliance. However, it is implicit that failing to comply with an AD issued by the Civil Aviation Safety Authority (CASA) can lead to significant safety risks. Non-compliance could potentially result in the grounding of the aircraft, as the authority has the power to enforce compliance through various regulatory measures. While the specific penalties are not detailed in this directive, the overarching implication is that non-compliance could lead to severe regulatory action, including potential fines and operational restrictions on the affected aircraft.
