Overview

The Civil Aviation Regulations 1998, enacted by the Parliament of Australia, were established to ensure the safe operation of civil aviation within the country. One of the critical aspects of these regulations is the implementation of Airworthiness Directives (ADs), which are legally enforceable rules aimed at correcting safety deficiencies in aircraft. The ADs are issued by the Civil Aviation Safety Authority (CASA) under the authority of the Civil Aviation Act 1988. AD/G1159/15, specifically targeting the Gulfstream (Grumman) G1159 and G-IV series aeroplanes, was introduced to address the specific safety concerns related to the aileron hydraulic system, as detailed in Gulfstream Customer Bulletin 224A. This directive aims to ensure that all relevant aircraft models comply with the latest safety requirements, thereby mitigating potential risks and enhancing overall aviation safety.

Scope and Application

The Civil Aviation Regulations 1998, specifically Part 39 - 105, applies to the Gulfstream (Grumman) G1159 and G-IV Series Aeroplanes as governed by Airworthiness Directive AD/G1159/15 Amendment 1. This legislation mandates compliance with Gulfstream Customer Bulletin 224A, which pertains to the aileron hydraulic system of all models within this series. The directive is applicable to all relevant aircraft models and requires actions to be taken in accordance with the specific requirements outlined in the Gulfstream Customer Bulletin 224A, as well as the detailed instructions provided in the Requirement Document. This Act is enforced under the jurisdiction of the Civil Aviation Safety Authority and is subject to the broader framework of the Civil Aviation Regulations 1998, ensuring that all aircraft operations meet the necessary safety standards.

Key Provisions

The primary operative sections of the Civil Aviation Regulations 1998, specifically within Part 39 - 105, detail the Civil Aviation Safety Authority's (CASA) Schedule of Airworthiness Directives for Gulfstream (Grumman) G1159 and G-IV series aeroplanes. Section 39.105.015 outlines the applicability of the directive to all models of the aircraft. The key requirement (section 39.105.015(1)) mandates action in accordance with Gulfstream Customer Bulletin 224A, which supersedes earlier bulletins such as Alert Customer Bulletin 7 and Customer Bulletin 224. Compliance with these directives is to be achieved as detailed in the Requirement Document. The obligations imposed by this legislation require all owners and operators of Gulfstream G1159 and G-IV series aeroplanes to adhere to the latest requirements as stipulated in Customer Bulletin 224A. This includes conducting necessary inspections, repairs, or modifications to the aileron hydraulic system as outlined by Gulfstream. Operators must ensure that all maintenance personnel are adequately trained and qualified to perform these tasks. Additionally, record-keeping is critical; operators must document all actions taken to comply with the bulletin, including the date of compliance and any parts replaced. Failure to comply with the airworthiness directives can result in significant civil and criminal consequences. Under section 97 of the Civil Aviation Act 1988, non-compliance may lead to enforcement actions by CASA, including fines, suspension or revocation of air operator certificates, and potential prosecution. The maximum penalty for contravening these directives can include fines of up to $1,650,000 for corporations and $330,000 for individuals, as per the penalties outlined in the Act. Furthermore, CASA may order the grounding of non-compliant aircraft, which could severely impact the operational viability of the airline or operator.
