Overview

The Civil Aviation Regulations 1998, administered by the Civil Aviation Safety Authority (CASA) under the Civil Aviation Act 1988, were enacted to ensure the safety and efficiency of civil aviation in Australia. This legislative instrument, specifically Part 39 - 105, focuses on the scheduling of airworthiness directives, which are legally enforceable safety standards for aircraft. The AD/F50/20 Amendment 1 pertains to Fokker F50 (F27 Mk 50) series aeroplanes, mandating compliance with the technical requirements of the Netherlands Airworthiness Directive BLA No. 89-038 Issue 2. This directive addresses the need for specific inspections and actions on the engine tailpipe assemblies of F50 series aircraft equipped with certain parts, thereby enhancing aviation safety by mitigating potential risks associated with these components. The policy objective behind this airworthiness directive is to ensure that the specified aircraft meet the necessary safety standards, thereby protecting the travelling public and maintaining the integrity of the Australian civil aviation system. The directive was amended to incorporate more stringent inspection requirements and to introduce a terminating action, reflecting the continuous effort to update and improve safety regulations in response to emerging issues and technological advancements.

Scope and Application

The Civil Aviation Regulations 1998, as amended, apply to all F50 series Fokker F50 (F27 Mk 50) aircraft that are equipped with either the P/N F8200-08-401 or F8200-08-403 exhaust tailpipe assemblies. The regulations are part of the broader legislative framework overseen by the Civil Aviation Safety Authority (CASA) and apply nationwide across the Commonwealth of Australia. The specific applicability of this legislation extends to the maintenance and operational standards of civil aircraft within Australia, ensuring that all such aircraft meet the necessary safety and airworthiness criteria. This legislation does not explicitly exclude any entities or persons, but its requirements are targeted towards those responsible for the maintenance and operation of F50 series Fokker F50 aeroplanes. The directive also incorporates technical requirements from the Netherlands Airworthiness Directive BLA No. 89-038 Issue 2, thereby extending its regulatory scope internationally. The compliance with this directive is mandatory, and failure to adhere to the specified technical requirements may result in safety and operational non-compliance.

Key Provisions

The key operative sections of the Civil Aviation Regulations 1998, specifically within Part 39 - 105, require all F50 series aircraft equipped with specific engine tailpipe assemblies (P/N F8200-08-401 or F8200-08-403) to comply with the technical requirements of the Netherlands Airworthiness Directive BLA No 89-038 Issue 2 (Section 1). This directive includes specific actions that must be taken in accordance with the revised requirement document, which has an effective date of 12 January 1992 (Section 1). The obligations imposed on the parties governed by this Act include ensuring that all applicable F50 series aircraft undergo the necessary inspections and actions as detailed in the Netherlands Airworthiness Directive BLA No 89-038 Issue 2. This involves inspecting and potentially modifying the engine tailpipe assemblies as specified, and ensuring that any revisions or actions are completed by the effective date of 12 January 1992 (Section 1). Operators and maintenance personnel must adhere to the detailed requirements to maintain compliance with the airworthiness standards set forth in the directive. Failure to comply with the provisions outlined in this directive can result in significant consequences. The Act imposes strict penalties for non-compliance, as breaching these airworthiness requirements can lead to serious safety hazards. The specific penalties for non-compliance are not detailed in the text provided, but generally, such breaches can result in enforcement actions by the Civil Aviation Safety Authority (CASA), including fines and potential grounding of the aircraft. The severity of the penalties reflects the critical nature of maintaining airworthiness standards to ensure public safety in aviation.
