Compliance: Prior to 31 August 1989.

Background:  The manufacturer has determined that the operating mechanism gearbox of the passenger, cargo, and service/emergency doors, can collect water as a result of condensation; which may freeze at low temperatures and prevent the mechanism from operating correctly.

Overview

The Civil Aviation Regulations 1998, as amended, are a critical piece of legislation governing civil aviation in Australia and were enacted to ensure the safety and efficiency of civil aviation operations within the country. The Civil Aviation Safety Authority (CASA) is the body responsible for administering these regulations, with a primary policy objective to safeguard the public by ensuring that civil aviation activities are conducted safely and efficiently. One specific aspect of these regulations, detailed in Part 39, concerns Airworthiness Directives (ADs) which are mandatory orders issued by CASA to address identified safety deficiencies in aircraft. The legislation aims to fill the gap by providing a legal framework that mandates adherence to safety standards and directives, thereby preventing potential hazards that could compromise flight safety. One example of such legislation in action is AD/F50/18, which pertains to Fokker F50 (F27 Mk 50) series aeroplanes. This directive was introduced to address the problem of water collection and subsequent freezing in the operating mechanism gearbox of the passenger, cargo, and service/emergency doors, which could impair the doors' functionality. The requirement set forth by this directive is that specific Fokker F50 models must comply with Fokker 50 Service Bulletin No F50-52-005, with compliance being necessary before 31 August 1989. The directive ensures that affected aircraft meet specified safety standards, thereby mitigating the risk of operational failures due to mechanical issues.

Scope and Application

The Civil Aviation Regulations 1998, specifically Part 39 - 105, apply to the Fokker F50 (F27 Mk 50) series aeroplanes with serial numbers ranging from 20103 to 20108 and 20110 to 20145. These regulations are established by the Civil Aviation Safety Authority (CASA) and are applicable on a national level throughout Australia. The primary focus of this legislation is to mandate compliance with Fokker 50 Service Bulletin No F50-52-005 to address the potential issue of water condensation and freezing in the operating mechanism gearbox of the aircraft's passenger, cargo, and service/emergency doors. This directive ensures that such aircraft maintain their airworthiness by preventing any mechanical failure that could arise from the freezing of collected water, thereby enhancing flight safety. There are no specific exclusions or exemptions mentioned in this directive; however, compliance must be achieved prior to 31 August 1989 as stipulated. The scope and specifics of this regulation may be further elaborated or amended through subordinate instruments issued by CASA.

Key Provisions

The key operative sections of the Civil Aviation Regulations 1998, specifically Part 39 - 105 and Schedule of Airworthiness Directives AD/F50/18, pertain to Fokker F50 (F27 Mk 50) Series Aeroplanes. The primary requirement is detailed in section 39 - 105, which mandates compliance with Fokker 50 Service Bulletin No F50-52-005. This directive applies to Fokker F50 aircraft with specific serial numbers, namely those ranging from 20103 to 20108 and from 20110 to 20145. The requirement is to address the issue of water accumulation in the door mechanism gearbox, which can freeze at low temperatures and impede proper operation. Compliance with this directive must be achieved prior to 31 August 1989, as referenced in RLD AD BLA 88-96. The Civil Aviation Regulations 1998 impose specific obligations on the parties or entities governed by AD/F50/18. Operators of Fokker F50 aircraft within the specified serial number range are required to implement the actions outlined in Fokker 50 Service Bulletin No F50-52-005. This involves addressing the potential for water accumulation in the door mechanism gearbox, ensuring that the mechanism remains functional even in low-temperature conditions. The regulations also mandate that compliance must be achieved by the stipulated deadline, thereby ensuring that the safety and operational integrity of the aircraft are maintained. In terms of offences and penalties, the Civil Aviation Regulations 1998 do not explicitly outline specific criminal or civil penalties for non-compliance with AD/F50/18. However, failure to adhere to airworthiness directives can have significant legal and safety implications. Non-compliance could potentially lead to the grounding of affected aircraft, which would result in operational disruptions and could incur substantial financial losses for the operators. Furthermore, any incidents or accidents resulting from non-compliance could lead to investigations by the Civil Aviation Safety Authority (CASA) and subsequent enforcement actions, including potential fines, penalties, or other regulatory sanctions. The overarching goal of these provisions is to ensure the safety and airworthiness of Fokker F50 aircraft, thereby protecting passengers, crew, and the general public.
