COMMONWEALTH OF AUSTRALIA (Civil Aviation Regulations 1998), PART 39 - 105 CIVIL AVIATION SAFETY AUTHORITY

SCHEDULE OF AIRWORTHINESS DIRECTIVES

Background: There have been many MLG torque link failures in the applicable aircraft.

Maintenance deficiencies caused reduced natural stability of the MLG lateral and torsional mode during landing causing failure. In-service experience also found that operators, despite improved maintenance procedures may not succeed in effectively eliminating torque link failures. Since a potentially unsafe condition still exists or may develop, this Directive requires installation of dampers on all applicable aircraft, and revised maintenance until that is accomplished.

Amendment 1 is raised to mandate replacement of the -1 and -3 dampers with modified -5 dampers.

The original issue of this Airworthiness Directive became effective on 5 December 1996.

The above AD is notified in the Commonwealth of Australia Gazette on 17 May 2000.

Overview

The Civil Aviation Regulations 1998, enacted by the Commonwealth of Australia, address various safety and operational standards within the civil aviation industry. Specifically, Part 39 - 105 focuses on the Civil Aviation Safety Authority's (CASA) Schedule of Airworthiness Directives, which are crucial in ensuring the safe operation of aircraft. One such directive, AD/F28/79, was introduced to address the problem of main landing gear (MLG) torque link failures in Fokker F28 Series Aeroplanes, particularly from the Mk 1000 to Mk 4000 series. The directive mandates rigorous inspections and modifications to the landing gear to prevent potential safety risks, such as reduced stability during landing, which could result from maintenance deficiencies. The policy objective of these directives is to ensure that all aircraft meet the necessary safety standards, thereby safeguarding the public and maintaining the integrity of the aviation industry.

Scope and Application

The Civil Aviation Regulations 1998, specifically PART 39 - 105, issued by the Civil Aviation Safety Authority (CASA) under the legislative instrument F2006B09813, mandates certain airworthiness directives for Fokker F28 Series aeroplanes. This directive applies to all Fokker F28 Mark 1000 to Mark 4000 aircraft across all serial numbers. The directive requires specific maintenance actions to address identified safety concerns related to the main landing gear (MLG) torque link dampers. The primary requirement is to inspect and, if necessary, replace the main landing gear torque link dampers in accordance with the instructions provided. These requirements are set to ensure the safety of the aircraft in operation, aiming to mitigate the risk of failures that could compromise the structural integrity and safety of the aeroplanes during landing. This directive applies nationally within Australia and is enforceable by CASA, ensuring compliance across all operators of the specified Fokker F28 aircraft series. The directive becomes effective from the date specified in its compliance section, with amendments updating or altering the original directive to reflect changes in safety requirements or maintenance procedures.

Key Provisions

The Civil Aviation Regulations 1998, specifically Part 39 - 105, detail a series of Airworthiness Directives issued by the Civil Aviation Safety Authority (CASA) to ensure aircraft safety. The highlighted Airworthiness Directive (AD/F28/79 Amendment 1) concerns Fokker F28 series aeroplanes, specifically the main landing gear torque link dampers. According to section (a) of the applicability clause, this directive applies to F28 Mk 1000 to Mk 4000 of all serial numbers. The requirement section (section 1) stipulates that the main landing gear must be inspected in accordance with Fokker Service Bulletin F28/32-151 dated 09 August 1996, and the main landing gear torque link dampers P/N 23700-1 and/or 23700-3 must be removed and replaced with modified main landing gear dampers P/N 23700-5, as per Fokker Service Bulletin SBF-28/32-157R1. This action is mandated in the circumstances outlined in the requirement section and must be completed at the specified times mentioned in the compliance section. The obligations imposed by this directive on the parties it governs are stringent and require careful adherence. Operators of the Fokker F28 series aeroplanes must ensure that the inspections and modifications are carried out as per the specified timelines. The inspection of the main landing gear must be performed within 1000 flight cycles after 05 December 1996 for part 1.D, and within 3000 flight cycles for parts 1.A, 1.B, and 1.C. Further inspections are mandated at intervals not exceeding 3000 flight cycles, and a final inspection must be completed before 30 May 1999. Additionally, unless previously carried out, the modifications must be completed within 24 months from the effective date of this directive, which is 15 June 2000. Failure to comply with this Airworthiness Directive can result in serious consequences. The Civil Aviation Regulations 1998 outline potential civil and criminal penalties for non-compliance with Airworthiness Directives. While the specific penalties are not detailed in the text, non-compliance with such directives generally results in severe repercussions, including fines and potential grounding of the aircraft until the required actions are taken. The safety of passengers and crew, as well as the integrity of the aircraft, is paramount, and CASA takes a firm stance against any deviation from the mandated safety protocols.
