Compliance: Before further flight after the effective date of this Directive.
This Airworthiness Directive becomes effective on 12 April 2000.
COMMONWEALTH OF AUSTRALIA (Civil Aviation Regulations 1998), PART 39 - 105 CIVIL AVIATION SAFETY AUTHORITY
SCHEDULE OF AIRWORTHINESS DIRECTIVES
Background: The Netherlands Rijksluchtvaartdienst (RLD) has received reports of inflight deployment of liftdumpers, this resulted in the issue of three separate Dutch airworthiness directives. CASA responded by issuing AD/F100/33 and AD/F100/38. Since then the RLD has received another report of inflight liftdumper deployment.
This Directive introduces an AFM amendment to ensure flight crew do not arm the liftdumpers before the landing gear is down and locked. The RLD anticipates that following further investigation, additional rulemaking action may be necessary.
Bernard Malcolm Hole
Delegate of the Civil Aviation Safety Authority 10 April 2000
The above AD is notified in the Commonwealth of Australia Gazette on 12 April 2000.
Overview
The Civil Aviation Regulations 1998 were enacted to regulate and ensure the safety of civil aviation in Australia, including the establishment of airworthiness standards and directives. In 2000, a specific Airworthiness Directive was issued under this Act to address the safety issue concerning the inflight deployment of liftdumpers on Fokker F100 (F28 Mk 100) series aeroplanes. This was in response to reports from the Netherlands Rijksluchtvaartdienst (RLD) regarding instances of liftdumper deployment during flight, which posed significant safety risks. The directive was issued by Bernard Malcolm Hole, a delegate of the Civil Aviation Safety Authority, under subregulation 39.1 (1) of the Civil Aviation Regulations 1998. The policy objective of this directive is to mandate specific amendments to the Aircraft Flight Manual to prevent the arming of the liftdumper system unless the landing gear is down and locked, thereby mitigating the risk of inflight deployment. This directive became effective on 12 April 2000, requiring compliance by aircraft operators before further flight.
Scope and Application
The Airworthiness Directive AD/F100/40 issued under the Civil Aviation Regulations 1998 applies specifically to Fokker F100 (F28 Mk 100) series aeroplanes, more precisely the model F.28 Mk.0070 and Mk.0100. This directive mandates an amendment to the Aircraft Flight Manual (AFM) to address safety concerns identified with the liftdumper system. The directive requires the AFM to include a new section detailing that the liftdumper system must not be armed before the landing gear is down and locked. This amendment aims to prevent the inflight deployment of liftdumpers, which has been reported and deemed unsafe. The compliance period stipulates that these AFM amendments must be implemented before further flight after the directive's effective date of 12 April 2000. The directive is issued by a delegate of the Civil Aviation Safety Authority (CASA), extending the regulatory reach of CASA to ensure compliance with the safety directive across relevant aircraft operators within the Commonwealth of Australia.
Key Provisions
The Civil Aviation Regulations 1998, under Part 39, Section 105, includes the Civil Aviation Safety Authority's (CASA) Schedule of Airworthiness Directives, which covers various aircraft, including the Fokker F100 (F28 Mk 100) series aeroplanes. Specifically, AD/F100/40 pertains to amendments in the Aircraft Flight Manual (AFM) for these models. This Airworthiness Directive (AD) mandates that operators amend their AFM to include new limitations and warnings regarding the use of the liftdumper system.
Section 1 - LIMITATIONS, sub-section MISCELLANEOUS LIMITATIONS, must be updated to include a new entry stating that the liftdumper system should not be armed unless the landing gear is down and locked. Similarly, Section 5 - NORMAL PROCEDURES, sub-section APPROACH AND LANDING, requires the insertion of a warning: "DO NOT ARM THE LIFT DUMPER SYSTEM BEFORE LANDING GEAR IS DOWN AND LOCKED." This amendment can be achieved by inserting a copy of this AD into the AFM. Operators must ensure compliance with these requirements before further flights after the AD's effective date, which is 12 April 2000.
Operators of Fokker F100 (F28 Mk 100) aeroplanes must strictly adhere to the provisions outlined in AD/F100/40. This includes updating their AFMs to reflect the new limitations and warnings concerning the liftdumper system. Specifically, they must ensure that the liftdumper system is not armed unless the landing gear is down and locked. This involves amending the AFM as directed and ensuring that all flight crews are aware of and comply with these new procedures. Failure to comply with this AD could result in serious safety risks, as the incorrect operation of the liftdumper system could lead to inflight deployment, potentially causing damage or compromising the aircraft's stability and control.
Failure to comply with the AD/F100/40 can result in significant legal and operational consequences. Under the Civil Aviation Regulations 1998, non-compliance with ADs is considered a breach of airworthiness requirements. Such breaches can lead to enforcement actions by CASA, which may include fines, suspension or revocation of aircraft operating certificates, and other penalties. Additionally, operators who fail to comply with ADs may face civil liability for any damages or injuries resulting from non-compliance. The severity of the penalties can vary, but they may include substantial fines and imprisonment for individuals responsible for the oversight of the non-compliance. Ensuring adherence to the AD is crucial to maintaining the safety and airworthiness of Fokker F100 (F28 Mk 100) aeroplanes in Australian airspace.
