COMMONWEALTH OF AUSTRALIA (Civil Aviation Regulations 1998), PART 39 - 107 CIVIL AVIATION SAFETY AUTHORITY
SCHEDULE OF AIRWORTHINESS DIRECTIVES
Emergency Equipment
AD/EMY/25 Emergency Evacuation Slide 4/92
Applicability: Air Cruisers Co., TSO-C69 Emergency Evacuation Slide Systems P/N D31005-( ), serial numbers 0001 through 0870 and P/N D30543-( ), serial numbers 0001 through 0067, installed on, but not limited to British Aerospace Model BAe-146 series aircraft.
Requirement: Replace the inflation cable and reidentify the emergency evacuation slide in accordance with paragraph 2, of the Accomplishment Instructions of Air Cruisers Co Service Bulletin 201-25-13.
Note: FAA AD 91-24-07 Amdt 39-8093 refers.
Compliance: Prior to 2 July 1992.
Background: The failure of an evacuation slide to properly deploy as a result of an incorrectly routed slide valve release cable, has prompted the issue of this Directive. The compliance time required by the FAA is extended by two months.
Overview
The Civil Aviation Regulations 1998 were enacted to ensure the safety of civil aviation within Australia. Part 39, specifically concerning the Civil Aviation Safety Authority’s schedule of airworthiness directives, addresses various safety measures for aircraft components and systems. The legislative instrument F2006B09544, issued under these regulations, focuses on emergency equipment, particularly the emergency evacuation slide systems for specific aircraft models. This directive was introduced to mitigate risks associated with the failure of evacuation slides to deploy correctly, which can be critical in emergency situations. The policy objective is to enhance passenger safety by ensuring that emergency equipment functions reliably, thereby preventing potential fatalities and injuries.
This legislative instrument was enacted by the Commonwealth of Australia and is enforced by the Civil Aviation Safety Authority. The problem it addresses is the potential failure of emergency evacuation slides due to issues with the inflation cable and slide valve release cable. The directive mandates the replacement of the inflation cable and reidentification of the emergency evacuation slide for specified models of British Aerospace BAe-146 aircraft, with compliance required prior to 2 July 1992. The regulation aligns with similar directives issued by the Federal Aviation Administration in the United States, reflecting a coordinated approach to aviation safety across jurisdictions.
Scope and Application
The Civil Aviation Regulations 1998, specifically Part 39, Airworthiness Directive AD/EMY/25, mandates the replacement of the inflation cable and reidentification of emergency evacuation slides for certain Air Cruisers Co. TSO-C69 Emergency Evacuation Slide Systems installed on British Aerospace Model BAe-146 series aircraft. This regulation applies to slide systems with specific part numbers and serial ranges, ensuring these aircraft meet critical safety standards. The geographic and jurisdictional reach of this directive is under the Commonwealth of Australia, enforced by the Civil Aviation Safety Authority (CASA), thereby impacting all operators of the specified aircraft within Australian airspace. Compliance with this directive is mandatory and must be achieved by the specified date, with any failure to comply potentially resulting in safety and regulatory repercussions. Notably, the directive extends the compliance period set by the Federal Aviation Administration (FAA) by an additional two months, providing additional time for operators to undertake the necessary modifications.
Key Provisions
The Civil Aviation Regulations 1998, under PART 39, specifically section 107, address the safety requirements for emergency equipment on certain aircraft, particularly focusing on emergency evacuation slides. According to AD/EMY/25, this section mandates that Air Cruisers Co. emergency evacuation slide systems, installed in British Aerospace Model BAe-146 series aircraft, must be modified (sections 0001 through 0870 and 0001 through 0067). The directive requires that the inflation cable of these slides be replaced, and the slides reidentified in line with the Accomplishment Instructions of Air Cruisers Co Service Bulletin 201-25-13, paragraph 2. This directive also references FAA AD 91-24-07 Amdt 39-8093 for additional context.
These regulations impose specific obligations on the operators of the affected aircraft. They must ensure that the required modifications are carried out before 2 July 1992, which is two months later than the original compliance deadline set by the Federal Aviation Administration (FAA). Operators must follow the detailed instructions provided in the referenced service bulletin, ensuring that the inflation cables are replaced and the slides are reidentified correctly. This includes verifying that all components are correctly installed and that the slides function as intended in the event of an emergency evacuation.
Failure to comply with these provisions may result in severe consequences. Although the Civil Aviation Regulations do not explicitly state penalties within this particular directive, non-compliance with civil aviation regulations generally can lead to significant civil and criminal penalties. Civil penalties might include fines, and criminal penalties could encompass imprisonment. These consequences are intended to ensure that safety standards are rigorously adhered to, thereby protecting passengers and crew in the event of an emergency. Operators are thus under a strict obligation to ensure full compliance with these safety directives to avoid any potential legal repercussions.
