COMMONWEALTH OF AUSTRALIA (Civil Aviation Regulations 1998), PART 39 - 105 CIVIL AVIATION SAFETY AUTHORITY
SCHEDULE OF AIRWORTHINESS DIRECTIVES
Embraer EMB-120 (Brasilia) Series Aeroplanes
AD/EMB-120/19
Amdt 1
Ice Detector System 5/98
Applicability: EMB 120 Brasilia aeroplanes serial numbers 120003 through 120339 inclusive.
Requirement: Install an ice detector system in accordance with Embraer Service Bulletin 120-30-0027 Revision 2 dated 3 December 1997.
Note 1: DAC (Brazil) AD 97-06-03R1 Amdt 39-821 refers.
Note 2: Incorporation of an ice detector system in accordance with previous issues of SB 120-30-0027 does not constitute compliance with this airworthiness directive.
Note 3: Revision 22 to the approved flight manual (AFM 120/1017) is complimentary to this airworthiness directive.
Compliance: Prior to 1 September 1998.
This amendment becomes effective on 23 April 1998.
Background: The Brazilian Departmento de Aviação Civil (DAC) has determined that a potential hazard (performance degradation) exists during unexpected icing encounters if the anti icing is not activated, due to either pilot unawareness or misjudgement, or if the icing conditions are so severe that the operation falls outside the certification limits. Severe icing is conducive to the formation of an ice build-up on protected surfaces which exceed the capability of the anti-ice system. Installation of an ice detection system is intended to ensure that aircrew is warned of significant ice accretion in time to take appropriate action before the formation of ice results in reduced controllability of the aeroplane.
This amendment introduces a revision to the service bulletin and extends the compliance time by three months.
The original issue of this airworthiness directive became effective on 6 November 1997.
Overview
The Civil Aviation Regulations 1998, specifically Part 39 - 105, provides regulatory oversight for airworthiness directives concerning aircraft safety in Australia. One such directive, AD/EMB-120/19 Amendment 1, was enacted to address the risk of ice detector systems in Embraer EMB-120 (Brasilia) Series Aeroplanes. This amendment, introduced by the Civil Aviation Safety Authority, aims to mitigate the hazards associated with unexpected icing encounters that can lead to performance degradation and compromised controllability of the aircraft. The amendment mandates the installation of an ice detection system in compliance with Embraer Service Bulletin 120-30-0027 Revision 2, extending the compliance period to ensure that the required safety measures are implemented effectively. This directive is crucial for maintaining the airworthiness of the specified aircraft models and enhancing flight safety.
Scope and Application
The Civil Aviation Regulations 1998, specifically Part 39 - 105, mandate the installation of an ice detector system on Embraer EMB-120 Brasilia series aeroplanes with serial numbers ranging from 120003 to 120339. This directive is applicable to aircraft within the Commonwealth of Australia, ensuring that these specific models are equipped with an ice detection system to mitigate the risks associated with unexpected icing conditions. The requirement is for compliance with Embraer Service Bulletin 120-30-0027 Revision 2 dated 3 December 1997, with compliance deadlines set prior to 1 September 1998, and the directive became effective from 23 April 1998. It is noteworthy that installations under previous issues of the service bulletin do not satisfy the requirements of this airworthiness directive, and revision 22 to the approved flight manual is complementary to this directive. This legislative instrument extends the application of the safety measures established by the Brazilian Departmento de Aviação Civil (DAC) to Australian-registered EMB 120 Brasilia aeroplanes, ensuring they meet the same safety standards as those in Brazil.
Key Provisions
The Civil Aviation Regulations 1998, specifically Part 39, includes provisions regarding airworthiness directives (ADRs) for various aircraft. One such directive, AD/EMB-120/19 Amendment 1, pertains to the Embraer EMB-120 Brasilia series aeroplanes (sections 105 and 120003 to 120339). According to this directive, these aircraft must have an ice detector system installed in compliance with Embraer Service Bulletin 120-30-0027 Revision 2, dated 3 December 1997 (section 105). This installation is crucial to mitigate the risks associated with unexpected icing conditions, which can degrade performance and potentially lead to severe ice accumulation on aircraft surfaces.
The obligations imposed by this directive require operators of the specified Embraer EMB-120 Brasilia series aeroplanes to ensure that the ice detector system is installed before 1 September 1998. This installation must follow the specifications outlined in the Embraer Service Bulletin, ensuring that the system is effective in detecting significant ice accretion. Failure to comply with these requirements can compromise the safety and airworthiness of the aircraft, potentially leading to regulatory non-compliance and operational risks. Operators are also required to incorporate the revisions to the approved flight manual (AFM 120/1017) as complementary to this airworthiness directive.
Failure to adhere to the provisions outlined in AD/EMB-120/19 Amendment 1 can result in significant consequences. Operators who do not comply with the installation of the ice detector system by the specified deadline may face regulatory enforcement actions. The Civil Aviation Safety Authority (CASA) has the authority to take measures against non-compliant operators, which could include fines, suspension of airworthiness certificates, or other enforcement actions. These penalties underscore the importance of timely compliance to ensure the safety and airworthiness of the affected aircraft.
