COMMONWEALTH OF AUSTRALIA (Civil Aviation Regulations 1998), PART 39 - 105 CIVIL AVIATION SAFETY AUTHORITY
SCHEDULE OF AIRWORTHINESS DIRECTIVES
AIRWORTHINESS DIRECTIVE
For the reasons set out in the background section, the CASA delegate whose signature appears below issues the following Airworthiness Directive (AD) under subregulation 39.1 (1) of CAR 1998. The AD requires that the action set out in the requirement section (being action that the delegate considers necessary to correct the unsafe condition) be taken in relation to the aircraft or aeronautical product mentioned in the applicability section: (a) in the circumstances mentioned in the requirement section; and (b) in accordance with the instructions set out in the requirement section; and (c) at the time mentioned in the compliance section.
Bombardier (Boeing Canada/de Havilland) DHC-8 Series Aeroplanes
AD/DHC-8/80 Observer Seat Latch 8/2001
Applicability: DHC-8 aircraft, Models 102, 103, 106, 201, 202, 301, 311, 314, and 315, with serial
numbers 408, 413, and 434 through 507; excluding serial numbers 452, 464, 490, and
506.
Requirement: Replace the observer’s seat latch assembly by incorporating ModSum 8Q100890 in accordance with the instructions contained in Bombardier Service Bulletin 8-25-307, dated 13 November 2000.
Note: Transport Canada AD CF-2001-18 refers.
Compliance: Before 15 June 2002, unless already accomplished.
This Airworthiness Directive becomes effective on 9 August 2001.
Background: The observer’s seat latch assembly and its attachment to the cockpit door frame have been found to be under strength on aircraft equipped with Hunting interiors. This could result in the seat separating from its attachment in the event of an accident or emergency landing.
David Alan Villiers
Delegate of the Civil Aviation Safety Authority 27 June 2001
The above AD is notified in the Commonwealth of Australia Gazette on 11 July 2001.
Overview
The Civil Aviation Regulations 1998 (CAR 1998) are a comprehensive set of rules and standards governing civil aviation in Australia, designed to ensure the safety and efficiency of air operations. Enacted by the Australian Parliament, the CAR 1998 addresses various aspects of civil aviation, including aircraft maintenance, airworthiness, and operational standards. One specific aspect of these regulations is the implementation of Airworthiness Directives (ADs) to ensure the ongoing safety of aircraft. AD/DHC-8/80 is one such directive issued by the Civil Aviation Safety Authority (CASA) to address the identified safety concern with the observer seat latch assembly on certain Bombardier (Boeing Canada/de Havilland) DHC-8 Series Aeroplanes. This directive mandates the replacement of the observer's seat latch assembly on specified models and serial numbers of DHC-8 aircraft to mitigate the risk of the seat detaching during an accident or emergency landing, thereby ensuring the continued airworthiness of the aircraft and the safety of its occupants.
Scope and Application
The Civil Aviation Regulations 1998, specifically PART 39 - 105, addresses the safety of civil aviation in Australia through Airworthiness Directives (ADs). One such AD pertains to Bombardier (Boeing Canada/de Havilland) DHC-8 Series Aeroplanes, targeting specific models and serial numbers, excluding certain serial numbers, to address an issue with the observer’s seat latch assembly. This directive mandates the replacement of the observer’s seat latch assembly by incorporating ModSum 8Q100890, following the instructions in Bombardier Service Bulletin 8-25-307, dated 13 November 2000. The requirement necessitates compliance before 15 June 2002, unless the action has already been completed, and the directive became effective on 9 August 2001. This AD is applicable to the Commonwealth of Australia, ensuring that the specified aircraft meet the necessary safety standards. The directive is notified in the Commonwealth of Australia Gazette, ensuring its reach and applicability across the relevant industry.
Key Provisions
The Civil Aviation Regulations 1998 (CAR 1998) under Part 39, specifically section 105, establish a schedule of Airworthiness Directives (ADs) to ensure aircraft safety. This AD, issued under subregulation 39.1(1) of the CAR 1998, applies to specific models of Bombardier (Boeing Canada/de Havilland) DHC-8 Series Aeroplanes, detailing requirements to replace the observer’s seat latch assembly. The directive mandates that affected aircraft must incorporate the ModSum 8Q100890 as per Bombardier Service Bulletin 8-25-307 dated 13 November 2000. This action is necessary to address an identified safety issue where the observer’s seat latch assembly and its attachment to the cockpit door frame were found to be under strength, which could lead to the seat detaching during an accident or emergency landing.
The AD imposes specific obligations on the owners and operators of the affected DHC-8 aircraft models. They are required to replace the observer’s seat latch assembly using the specified modification (ModSum 8Q100890) and following the instructions outlined in Bombardier Service Bulletin 8-25-307. This compliance must be achieved before 15 June 2002, unless the modification has already been completed. Failure to adhere to these requirements can result in serious safety risks, potentially compromising the structural integrity of the aircraft during critical events.
The AD clearly outlines the consequences of non-compliance. Entities failing to meet the requirements set forth in this AD risk facing civil or criminal penalties as prescribed under the Civil Aviation Act 1988 and associated regulations. The specific penalties can include fines and potential criminal charges for operators who do not adhere to the mandated safety directives. The seriousness of these potential penalties underscores the importance of timely compliance to ensure the safety and airworthiness of the aircraft involved.
