Overview

The Civil Aviation Regulations 1998, specifically in Part 39 - 105, detail the Civil Aviation Safety Authority's (CASA) schedule of airworthiness directives, including the requirement for DHC-3 (Otter) Series Aeroplanes, as addressed by AD/DHC-3/27. This legislation was enacted to enhance the safety of front seat restraints on these aircraft by mandating the installation of safety harnesses in accordance with a scheme approved by the Secretary. This directive applies to all models of the DHC-3 (Otter) Series Aeroplanes, with a compliance deadline of before 1 October 1973, aiming to ensure that these aircraft meet specified safety standards. The policy objective is to mitigate risks associated with the operation of these aeroplanes by enforcing standardised and approved safety measures for the front seat restraints.

Scope and Application

The Civil Aviation Regulations 1998, specifically Part 39 - 105, pertains to the installation of safety harnesses in DHC-3 (Otter) series aeroplanes as mandated by the Civil Aviation Safety Authority. This regulation applies to all models of DHC-3 aircraft, encompassing any entity or individual operating such aeroplanes within the Commonwealth of Australia. The requirement is to modify each front seat restraint installation by fitting a safety harness that must conform to a scheme approved by the Secretary. Detailed guidelines for the installation schemes are provided in Airworthiness Advisory Circular No 2, dated March 1972, which supports the implementation of these safety measures. Compliance with this directive is mandatory, with a specified deadline of before 1 October 1973, ensuring that all necessary modifications are completed to maintain airworthiness standards and enhance safety.

Key Provisions

The Civil Aviation Regulations 1998, specifically in Part 39 - 105, outline several key provisions concerning the airworthiness of DHC-3 (Otter) series aeroplanes. Section 39-105, concerning Airworthiness Directives, mandates that all models of DHC-3 aeroplanes must be modified to fit a safety harness in each front seat restraint installation. This requirement is articulated in Airworthiness Directive AD/DHC-3/27, which specifies that these modifications must adhere to a scheme approved by the Secretary (section 39-105(1)). Additionally, the note in section 39-105(2) directs that guidelines for installation schemes can be found in Airworthiness Advisory Circular No 2 dated March 1972. Compliance with these modifications is mandated before 1 October 1973 (section 39-105(3)). The obligations imposed by this legislation on the parties involved, particularly aircraft operators and maintenance organisations, are clear and precise. Operators of DHC-3 aeroplanes must ensure that all front seat restraint installations are modified to include a safety harness as per the approved scheme. This includes conducting the necessary modifications before the specified compliance date of 1 October 1973. Maintenance organisations, in turn, must carry out these modifications according to the approved guidelines outlined in Airworthiness Advisory Circular No 2. These obligations are designed to enhance the safety of pilots during flight operations by providing a reliable restraint system in the front seats. Failure to comply with the provisions of these Civil Aviation Regulations can result in serious consequences. Under section 39-105, non-compliance with the Airworthiness Directives can lead to enforcement actions by the Civil Aviation Safety Authority. Specifically, the authority may take measures to prevent non-compliant aircraft from operating until the necessary modifications are made. Additionally, non-compliance may result in administrative penalties, including fines and potential legal action against the operator or maintenance organisation responsible for the non-compliance. The exact penalties are determined based on the severity and nature of the breach, but they can be significant, underscoring the importance of adhering to these safety regulations.
