Overview

The Civil Aviation Regulations 1998, enacted by the Parliament of Australia, are a comprehensive set of rules governing aviation safety, among other things. One of the legislative instruments within this framework is F2006B05183, which introduces specific Airworthiness Directives for certain aircraft models to ensure their safety and airworthiness. This particular directive, AD/CESSNA 188/7 Amendment 1, pertains to the aileron spar of Cessna 188 (Agwagon) Series Aeroplanes. It was introduced to address specific safety concerns related to the aileron spar in certain models of these aircraft. The directive requires compliance with Rex Aviation Tech. Memo No. TM21 and mandates inspections at intervals not exceeding 100 hours of time in service to ensure the structural integrity of the affected components. The policy objective is to maintain the highest safety standards in civil aviation by ensuring that all aircraft meet specific safety criteria and are regularly inspected and maintained accordingly.

Scope and Application

The Civil Aviation Regulations 1998, specifically PART 39 - 105, apply to the Cessna 188 (Agwagon) series aeroplanes with serial numbers ranging from 188-0001 to 188-02348, excluding those modified with later part numbers for the inboard, centre, and outboard hinges, including the shim part number 1620089-1 for the centre hinge. This regulation sets forth the safety directives for these aircraft and mandates compliance with the technical memorandum issued by Rex Aviation, specifically Technical Memorandum No. TM21. Compliance with these directives is required at intervals not exceeding 100 hours of time in service, ensuring that the specified aircraft maintain airworthiness and safety standards. This regulation is applicable across the Commonwealth of Australia, enforcing stringent safety and operational standards within the civil aviation sector.

Key Provisions

The Civil Aviation Regulations 1998 (Cth), specifically Part 39 - 105, details the Civil Aviation Safety Authority (CASA) Schedule of Airworthiness Directives, which include directives for specific aircraft models. In this case, AD/CESSNA 188/7 Amendment 1 addresses the aileron spar for Cessna 188 (Agwagon) series aeroplanes. According to section 10/79, this directive applies to all models 188 and A188 with serial numbers ranging from 188-0001 to 188-02348 that have not been modified by fitting later part numbers at the inboard, centre, and outboard hinges, including the shim part number 1620089-1 at the centre hinge. The directive mandates that action must be taken in accordance with Rex Aviation Technical Memorandum No. TM21. The Cessna 188 (Agwagon) series aeroplanes, as governed by this directive, must adhere to specific maintenance requirements to ensure airworthiness. According to section 10/79, the required action must be performed in line with the technical memo TM21, which likely includes detailed inspection and maintenance procedures for the aileron spars. Compliance with this directive is mandatory, and the specified action must be carried out at intervals not exceeding 100 hours of time in service. This ensures that the structural integrity of the aileron spars is regularly assessed and maintained to meet safety standards. Failure to comply with the airworthiness directives set forth in the Civil Aviation Regulations 1998 can result in serious consequences. Although specific penalties for non-compliance with AD/CESSNA 188/7 Amendment 1 are not detailed in the excerpt, general provisions of the Civil Aviation Act 1988 (Cth) may apply. Non-compliance with CASA directives can lead to enforcement actions, which may include fines, suspension or revocation of aircraft certificates, and potentially criminal charges. The severity of the penalty often depends on the nature and extent of the non-compliance, as well as any resultant safety risks. Ensuring adherence to these directives is crucial to maintaining the safety and legality of the aircraft operations.
