Overview
The Civil Aviation Regulations 1998, specifically Part 39 - 105, includes an Airworthiness Directive (AD) issued by the Civil Aviation Safety Authority (CASA) to address safety concerns associated with the Pilatus Britten-Norman BN-2 Series Aeroplanes. The AD, numbered AD/BN-2/70, pertains to the elevator outboard hinge bracket and was enacted to respond to reports of cracks and loose rivets in this component, part number NB-31-0077. This directive, effective from 5 October 2000, mandates inspections of the specified aircraft models to mitigate the identified unsafe condition. The requirement is to inspect the elevator outboard hinge bracket in accordance with B-N Group Service Bulletin BN2/SB.259 Issue 1, with an initial inspection within 100 hours of service after the directive's enactment and subsequent reinspections at intervals not exceeding 1000 hours if the bracket has been replaced, or 100 hours if it has not.
Scope and Application
The Airworthiness Directive issued under the Civil Aviation Regulations 1998 applies to specific models of the Pilatus Britten-Norman BN-2 series aircraft, namely BN2, BN2A, BN2B, BN2T, and BN2T-4S. This AD mandates that inspections of the elevator outboard hinge bracket be conducted in accordance with the instructions detailed in B-N Group Service Bulletin BN2/SB.259 Issue 1. The AD applies to these aircraft irrespective of the location within Australia or the ownership of the aircraft, as it is issued by the Civil Aviation Safety Authority (CASA), a Commonwealth authority. The directive outlines specific timeframes for initial and subsequent inspections, with varying intervals based on whether the hinge bracket has been replaced or not. Notably, this Airworthiness Directive is effective from 5 October 2000, and the requirement to publish this notice in the Commonwealth of Australia Gazette ensures its legal enforceability across the country.
Key Provisions
The Civil Aviation Regulations 1998, under Part 39 – 105, specifically addresses the airworthiness of certain aircraft types. The Airworthiness Directive AD/BN-2/70 pertains to the Pilatus Britten-Norman BN-2 Series aeroplanes, covering models BN2, BN2A, BN2B, BN2T, and BN2T-4S (section 1). This directive mandates actions to address a specific unsafe condition related to the elevator outboard hinge bracket.
The directive, issued under subregulation 39.1(1) of the Civil Aviation Regulations 1998, requires the inspection of the elevator outboard hinge bracket in accordance with the instructions provided in the B-N Group Service Bulletin BN2/SB.259 Issue 1 (section 2). The inspection must occur within 100 hours after 5 October 2000, and subsequent reinspections must be conducted at intervals not exceeding 1000 hours if the hinge bracket has been replaced according to the service bulletin. If the hinge bracket has not been replaced, the reinspection interval is 100 hours (section 3). The directive came into effect on 5 October 2000 (section 4).
The Airworthiness Directive imposes specific obligations on the operators of the affected aircraft. Operators must ensure that the elevator outboard hinge bracket is inspected within 100 hours of the directive's effective date, 5 October 2000, and follow the inspection intervals as outlined in the directive (section 5). Additionally, operators must adhere to the service bulletin instructions, which include replacing the hinge bracket if necessary and conducting the appropriate reinspections at the specified intervals (section 6).
Failure to comply with the Airworthiness Directive may result in significant consequences. The Civil Aviation Regulations 1998 impose penalties for non-compliance with airworthiness directives. These penalties can include fines and potential legal action against the operator or individual responsible for the non-compliance. The specific penalties can vary based on the severity of the non-compliance and the discretion of the court (section 7).
