Overview

The Civil Aviation Regulations 1998, administered by the Civil Aviation Safety Authority (CASA), were enacted to provide comprehensive safety regulations for civil aviation in Australia. Among these regulations, Part 39 - 105 includes Airworthiness Directives (ADs) that address specific safety concerns for particular aircraft models. One such directive, AD/BELL 47/87 Amendment 1, pertains to the Bell Helicopter Textron 47 (all variants) series helicopters and specifically targets the stabiliser bar damper frame clamp. This directive was introduced to address the problem of stabiliser bar damper frame clamp failure, as evidenced by eight known cases, ensuring that the safety of these aircraft is maintained by requiring compliance within 25 hours of time in service after 30 September 1981. The policy objective of this amendment is to mitigate the risk of in-flight failure of the stabiliser bar damper frame clamp, thereby enhancing overall aviation safety.

Scope and Application

The Civil Aviation Safety Authority (CASA) Schedule of Airworthiness Directives, specifically AD/BELL 47/87 Amendment 1, pertains to all Bell Helicopter Textron 47 (All Variants) Series helicopters that are fitted with a stabiliser bar damper frame clamp identified by parts numbers 47-140-134-001 or 47-140-134-1001. This legislation applies to all operators of these specified helicopters, ensuring compliance with safety directives aimed at mitigating the risk of stabiliser bar damper frame clamp failure. The directive mandates that corrective actions be undertaken within 25 hours of time in service following 30 September 1981. This amendment extends the applicability of the directive to include Kawasaki-Bell helicopters, thereby broadening the scope of the directive to cover additional aircraft models. The legislation is applicable on a national level within Australia, enforcing compliance across all states and territories under the purview of the Commonwealth's civil aviation regulatory framework. There are no stated exclusions or exemptions within the scope of this directive, and it does not impose any specific thresholds; rather, it mandates prompt action upon the specified condition being met. The directive’s application can be further refined or extended through subordinate instruments issued by CASA, ensuring that safety standards are consistently met and adapted to any new developments or findings.

Key Provisions

The Civil Aviation Regulations 1998, under Part 39 - 105, mandate specific airworthiness directives for certain aircraft models to ensure their safe operation. Specifically, AD/BELL 47/87 Amendment 1 pertains to the Bell Helicopter Textron 47 (All Variants) Series Helicopters, particularly those equipped with a stabiliser bar damper frame clamp part number 47-140-134-001 or 47-140-134-1001. This directive requires compliance within 25 hours of time in service after 30 September 1981. The directive references Bell ASB 47-81-7 and includes Kawasaki-Bell Helicopters, acknowledging the manufacturer's reports of eight known cases of stabiliser bar damper frame clamp failure. The obligations under this directive are clear and straightforward. Operators of the affected Bell Helicopter Textron 47 series helicopters must ensure that the stabiliser bar damper frame clamp is inspected and, if necessary, replaced or repaired within the specified timeframe. The directive mandates adherence to the instructions provided in the referenced documents, Bell ASB 47-81-7 and Kawasaki-Bell S.B. KSB-Bell 354, to maintain the required airworthiness standards. This directive is not optional; it is a regulatory requirement enforced by the Civil Aviation Safety Authority (CASA) to mitigate the risk of stabiliser bar damper frame clamp failure, which could compromise flight safety. Failure to comply with the airworthiness directive stipulated in the Civil Aviation Regulations 1998 can lead to severe consequences. The Civil Aviation Act 1988 outlines various penalties for non-compliance with airworthiness directives. If an operator does not adhere to the requirements, they may face legal action, which can include fines and other sanctions. The severity of the penalties can depend on the degree of non-compliance and the potential risk to safety posed by the failure to comply with the directive. Additionally, non-compliance could result in the grounding of the aircraft, further compounding the financial and operational repercussions for the operator.
