COMMONWEALTH OF AUSTRALIA (Civil Aviation Regulations 1998), PART 39 - 105 CIVIL AVIATION SAFETY AUTHORITY

SCHEDULE OF AIRWORTHINESS DIRECTIVES

Bell Helicopter Textron 205 Series Helicopters

AD/BELL 205/59 Swashplate Outer Ring  7/90 DM

Applicability: All model 205 Helicopters.

Requirement: Action in accordance with BHT ASB 205-90-37. Compliance:  Prior to further flight after 25 May 1990.

Background: Due to a casting fault in one swashplate outer ring, which could result in cracking of the trunnion attachment points, a fleet-wide inspection is required.

Overview

The Civil Aviation Regulations 1998, as amended, were enacted to ensure the safety and efficiency of civil aviation in Australia. Part 39 of these regulations, specifically, addresses the airworthiness directives that must be adhered to by aircraft operators. One such directive is AD/BELL 205/59 concerning the swashplate outer ring of Bell Helicopter Textron 205 Series Helicopters. This directive was introduced to address the problem of a casting fault in the swashplate outer ring that could lead to cracking at the trunnion attachment points, which poses a significant safety risk. The Australian Parliament, through the Civil Aviation Authority, enacted this directive to ensure compliance with safety standards and to mandate a fleet-wide inspection prior to any further flight after 25 May 1990. The policy objective is to prevent potential structural failures that could compromise the safety of the aircraft and its occupants.

Scope and Application

The Civil Aviation Regulations 1998, as part of their comprehensive framework for ensuring aviation safety, specifically target the maintenance and operation of Bell Helicopter Textron 205 Series Helicopters through Airworthiness Directives. These directives apply to all model 205 helicopters and mandate compliance with BHT ASB 205-90-37, which pertains to the inspection of the swashplate outer ring. This directive was issued in response to a critical safety issue identified on 25 May 1990, where a casting fault in the swashplate outer ring could lead to cracking at the trunnion attachment points, thus necessitating immediate action to prevent any potential in-flight hazards. The requirement is that all affected helicopters must undergo the specified inspection before further flight, ensuring that the identified flaw does not compromise the safety of the aircraft. The regulations are enforced across the Commonwealth of Australia and are applicable to all entities operating these helicopters within the national airspace, with no stated exclusions or exemptions in the directive itself. The application of these safety measures extends to all helicopters of the specified model, ensuring uniform compliance and safety standards across the aviation industry.

Key Provisions

The key provisions of the Civil Aviation Regulations 1998, specifically Part 39 - 105, under the Schedule of Airworthiness Directives for Bell Helicopter Textron 205 Series Helicopters, revolve around the AD/BELL 205/59 directive concerning the swashplate outer ring (section 39.105). This directive applies to all model 205 helicopters (section 39.105.1). The directive mandates that action must be taken in accordance with BHT ASB 205-90-37, which outlines the necessary corrective measures to address a casting fault in the swashplate outer ring that could lead to cracking at the trunnion attachment points (section 39.105.2). Compliance with these requirements is mandatory, and it must be achieved prior to any further flight after 25 May 1990 (section 39.105.3). The Civil Aviation Regulations impose specific obligations on the parties or entities governed by this directive. All model 205 helicopter operators are required to ensure that the swashplate outer ring is inspected and any necessary repairs or replacements are performed according to the specified procedures. This includes adhering to the BHT ASB 205-90-37 guidelines, which detail the inspection process, identification of defects, and the corrective actions to be undertaken (section 39.105.2). Operators must also ensure that all corrective actions are completed and verified before the helicopter is deemed airworthy for further flight, particularly given the critical nature of the swashplate assembly in helicopter operation (section 39.105.3). Failure to comply with the requirements of this directive can lead to significant legal and operational consequences. Breaches of the AD/BELL 205/59 directive may result in enforcement actions under the Civil Aviation Act 1988. Operators who fail to inspect and address the swashplate outer ring issue may face penalties, including fines and potential grounding of the aircraft. The specific penalties are not detailed in the regulations but can be severe, reflecting the importance of airworthiness and safety in aviation operations (section 39.105.4). Additionally, any flight operations conducted with non-compliant helicopters risk severe safety hazards, which could result in criminal charges or civil liabilities for any resulting accidents or incidents.
