Overview
The Civil Aviation Regulations 1998, enacted by the Parliament of Australia, address gaps in ensuring the safe operation of civil aircraft within Australian airspace. This regulation, specifically Part 39, provides detailed safety directives to maintain airworthiness standards, particularly for certain types of aircraft. The policy objective is to ensure that aircraft meet the highest safety standards, thus protecting passengers, crew, and the general public from aviation-related hazards. One such directive, AD/BEECH 55/34 Amendment 1, focuses on the landing gear shock strut piston of Beechcraft 55, 58, and 95-55 (Baron) Series aeroplanes. This amendment mandates specific actions to be taken in accordance with Beechcraft Service Information No. 0612-200, ensuring compliance within 100 hours of time in service after 31 January 1974, unless the action has already been completed.
Scope and Application
The Civil Aviation Regulations 1998, specifically Part 39 - 105 and Schedule of Airworthiness Directives concerning Beechcraft 55, 58 and 95-55 (Baron) Series Aeroplanes, outlines mandatory requirements for the maintenance and airworthiness of specified aircraft models. This regulation applies to all model 95-B55 aircraft with serial numbers TC-1552 to TC-1607, excluding TC-1557, TC-1558, TC-1559, and TC-1604; model E55 and E55A aircraft with serial numbers TE-914 to TE-940, excluding TE-919, TE-920, and TE-938; and model 58 and 58A aircraft with serial numbers TH-325 to TH-383, excluding TH-336, TH-337, TH-363, and TH-382. The requirement is for the aircraft to comply with Beechcraft Service Instruction No. 0612-200 regarding the landing gear shock strut piston. Compliance with these directives must be achieved within 100 hours of time in service after 31 January 1974, or if the action has already been completed, it need not be repeated. This regulation is enforced under the authority of the Commonwealth of Australia and applies to the specified aircraft models within the national jurisdiction.
Key Provisions
The Civil Aviation Regulations 1998, particularly Part 39 - 105, contain several sections that mandate specific actions to ensure the airworthiness of certain aircraft. One key section, AD/BEECH 55/34 Amendment 1, pertains to the landing gear shock strut piston of specific Beechcraft 55, 58, and 95-55 (Baron) Series aeroplanes. This directive applies to all model 95-B55 with serial numbers from TC-1552 to TC-1607, excluding TC-1557, TC-1558, TC-1559, and TC-1604, as well as all model E55 and E55A with serial numbers from TE-914 to TE-940, excluding TE-919, TE-920, and TE-938, and all model 58 and 58A with serial numbers from TH-325 to TH-383, excluding TH-336, TH-337, TH-363, and TH-382.
These sections require aircraft owners and operators to take specific action in accordance with Beechcraft Service Information (SI) No. 0612-200. This action must be completed within 100 hours of time in service after 31 January 1974, unless it has already been accomplished. Compliance with this directive is crucial to maintain the safety standards set by the Civil Aviation Safety Authority (CASA).
The obligations imposed by these provisions are clear and precise. Aircraft owners and operators must ensure that the specified actions are taken on the relevant aircraft within the prescribed timeframe. This involves following the instructions outlined in the Beechcraft SI No. 0612-200, which likely includes detailed technical procedures for inspecting, maintaining, or repairing the landing gear shock strut piston.
Failure to comply with the airworthiness directives can lead to serious consequences. While the Civil Aviation Regulations 1998 do not explicitly state penalties for non-compliance within this specific directive, general provisions of the Act may apply. Violations can result in civil or criminal penalties, including fines and imprisonment. The severity of these penalties depends on the nature and extent of the non-compliance, and CASA may also impose additional administrative actions such as grounding the aircraft or revoking the operator's certificate.
