Overview
The Civil Aviation Regulations 1998, as amended, is a fundamental piece of legislation within Australia's aviation regulatory framework, overseen by the Civil Aviation Safety Authority (CASA). The regulations were enacted to ensure the safety and efficiency of civil aviation operations within the country, addressing the need for a comprehensive set of rules governing various aspects of aviation, including aircraft airworthiness, pilot licensing, and operational procedures. One particular legislative instrument, AD/BEECH 36/25, pertains to Beechcraft 36 (Bonanza) Series Aeroplanes, focusing on the installation and modification of the front seat restraint system. This directive was introduced to enhance safety by mandating modifications to the upper torso restraint installation of specified aircraft models, ensuring they comply with approved schemes, such as those referenced in Molyneux Drawing No. MAD 1048.
This legislative instrument is part of a broader effort to maintain high safety standards within Australia's civil aviation sector. The policy objective underlying this specific directive is to mitigate potential risks associated with the front seat restraint installations in Beechcraft 36 Series Aeroplanes, thereby protecting the safety of passengers and crew. The requirement to modify the restraint installation within a specified timeframe underscores the commitment to promptly address safety concerns and ensure that all aircraft operating under Australian jurisdiction meet stringent safety criteria.
Scope and Application
The Civil Aviation Safety Authority Schedule of Airworthiness Directives, specifically AD/BEECH 36/25, pertains to all Beechcraft 36 (Bonanza) series aeroplanes that feature a front seat restraint installation as per Civil Flying Service Drawing No. CF1010. This legislative instrument applies to the aircraft operators and maintenance personnel responsible for ensuring compliance with the specified airworthiness directive. The directive mandates the modification of the upper torso restraint installation in accordance with a scheme approved by the Secretary, with a noted acceptable means of compliance being the modification to Molyneux Drawing No. MAD 1048. It is imperative for these modifications to be carried out within 100 hours of time in service following 31 December 1976. Notably, the approval of Civil Flying Services Drawing No. CF1010 has been withdrawn, rendering it no longer an acceptable reference for compliance purposes. The directive is administered under the Commonwealth of Australia's Civil Aviation Regulations 1998, reflecting a national jurisdictional reach.
Key Provisions
The Civil Aviation Safety Authority (CASA) has issued Airworthiness Directive (AD) AD/BEECH 36/25, which applies to all models of the Beechcraft 36 (Bonanza) series aeroplanes that have front seat restraint installations specified in Civil Flying Service Drawing No. CF1010 (Section 1). This directive requires the modification of the upper torso restraint installation, in accordance with a scheme approved by the Secretary (Section 2). It is noted that modifying the restraint installation to comply with Molyneux Drawing No. MAD 1048 is an acceptable means of achieving compliance (Section 3, Note 1). Furthermore, approval of the Civil Flying Services Drawing No. CF1010 has been withdrawn (Section 3, Note 2).
Entities and operators governed by this AD must ensure that the specified modifications to the front seat restraint installations are completed within 100 hours of time in service following 31 December 1976 (Section 4). These modifications are necessary to maintain the airworthiness of the aircraft and ensure the safety of the occupants during flight. Operators must adhere to the approved scheme or the Molyneux Drawing No. MAD 1048 as an acceptable alternative to comply with the AD.
Failure to comply with the requirements outlined in AD/BEECH 36/25 may result in the aircraft being considered unairworthy. This could lead to potential safety hazards and non-compliance with the Civil Aviation Regulations 1998 (CAR). In severe cases, operators may face legal consequences, including fines, prosecution, or even the grounding of the aircraft. The exact penalties and consequences for non-compliance depend on the severity of the breach and the discretion of the relevant authorities. However, it is essential for operators to adhere to the AD to ensure the continued safety and airworthiness of their Beechcraft 36 (Bonanza) series aeroplanes.
