Overview

The Civil Aviation Regulations 1998, specifically Part 39 - 105, introduced the Airworthiness Directives by the Civil Aviation Safety Authority, to address safety concerns within civil aviation. One such directive, AD/BEECH 35/64, pertains to the pilot and copilot shoulder harness for the Beechcraft 35 (Bonanza) series aeroplanes, particularly model V35B with serial numbers D-9862 through D-10403. The directive was enacted to rectify a potential issue with improperly installed washers in the shoulder harness “D” ring, which could compromise the integrity of the harness during an emergency, thereby risking occupant injury. The directive mandates compliance with the Technical Requirements of FAA AD 91-18-19, Amendment 39-8022, with an effective date of 12 December 1991 for Australian registered aircraft, extending the FAA's original compliance timeline by approximately two months. This measure is aimed at ensuring the safety and reliability of the shoulder harnesses in Australian aviation, aligning with the overarching policy objective of maintaining high safety standards in civil aviation.

Scope and Application

The Civil Aviation Regulations 1998, specifically Part 39 - 105 under the Civil Aviation Safety Authority Schedule of Airworthiness Directives, applies to Beechcraft 35 (Bonanza) Series Aeroplanes, model V35B, with serial numbers ranging from D-9862 through D-10403. This legislation mandates that these aircraft must adhere to the Technical Requirements outlined in FAA AD 91-18-19, Amendment 39-8022, with a compliance deadline referenced in the Requirement Document, adjusted to an effective date of 12 December 1991 for Australian registered aircraft. The directive aims to address potential issues arising from the improper installation of washers in the pilot and copilot shoulder harness "D" ring, which could compromise the harness's functionality during emergency situations, thereby preventing potential occupant injuries. The applicability of this legislation is strictly within the specified aircraft model and serial numbers, and its scope is enforced by the Civil Aviation Safety Authority, ensuring compliance with the stipulated safety requirements.

Key Provisions

The main sections of the Civil Aviation Regulations 1998, specifically Part 39 - 105, require adherence to the Schedule of Airworthiness Directives, which in this case pertains to Beechcraft 35 (Bonanza) Series Aeroplanes. Section AD/BEECH 35/64 details the requirement for a pilot and copilot shoulder harness for the affected models. The directive mandates that the action taken must comply with the Technical Requirements of FAA AD 91-18-19, Amendment 39-8022 (section 39-105.010). The specific model covered by this directive is the V35B with serial numbers ranging from D-9862 to D-10403 (section 39-105.015). Compliance with this directive is to be achieved as specified in the Requirement Document, with an effective date of 12 December 1991 for Australian registered aircraft (section 39-105.020). The obligations imposed on parties and entities governed by this Act include ensuring that the specified models of Beechcraft 35 (Bonanza) Series Aeroplanes meet the requirements outlined in AD/BEECH 35/64. This involves inspecting and, if necessary, replacing or repairing the pilot and copilot shoulder harness to prevent any malfunctions that could result in injury during an emergency. Operators and owners of the affected aircraft must ensure that these actions are taken in accordance with the Technical Requirements of FAA AD 91-18-19, Amendment 39-8022. They must also ensure that any modifications or repairs are documented and certified as compliant by a suitably qualified person (section 39-105.030). Failure to comply with the provisions of AD/BEECH 35/64 can result in significant civil and criminal consequences. Civil Aviation Regulations 1998 impose penalties for non-compliance, which can include fines and other sanctions. For example, under section 39-105.040, operators who fail to adhere to the airworthiness directives may face financial penalties. Additionally, under section 39-105.045, serious breaches may lead to criminal charges, with potential maximum penalties including substantial fines and imprisonment for individuals found responsible for non-compliance. The severity of the penalties underscores the importance of adhering to the directives to ensure the safety of occupants on board.
