Overview

The Civil Aviation Regulations 1998, as amended, include Part 39 – 105, which provides the Civil Aviation Safety Authority (CASA) with the authority to issue airworthiness directives. One such directive is AD/BEECH 33/10 Amendment 1, which pertains to the propeller governor control linkage of specific Beechcraft 33 and 35-33 (Debonair/Bonanza) series aeroplanes. This directive was introduced to address the need for maintaining the airworthiness of certain aeroplanes by ensuring the integrity of their propeller governor control linkage. The policy objective is to mandate compliance with specific maintenance procedures to ensure the safety and reliability of these aircraft models in operation. The directive requires actions to be taken in accordance with Beechcraft Service Instruction No. 0401-254 Revision 1, with compliance required within specific timeframes post the directive’s issuance on 25 February 1972. This includes initial inspections within 25 hours of time in service or within 100 hours for those already inspected under a prior directive, and subsequent inspections at intervals not exceeding 100 hours of time in service. This legislative instrument is a critical component of Australia's aviation safety framework, ensuring that the specified aircraft meet the necessary safety standards to operate safely in Australian airspace.

Scope and Application

The Civil Aviation Regulations 1998, specifically under Part 39, pertains to airworthiness directives which are essential regulatory measures aimed at ensuring the safety and airworthiness of aircraft. The regulation AD/BEECH 33/10 Amendment 1 addresses the maintenance and inspection requirements for the propeller governor control linkage of Beechcraft 33 and 35-33 (Debonair/Bonanza) series aeroplanes. This directive applies to specific models of these aircraft that are equipped with governors that do not incorporate Woodward Service Bulletin No. 33535. The geographic reach of this regulation is national, as it applies across Australia in compliance with the overarching framework established by the Civil Aviation Regulations 1998. The requirement outlined in this directive must be followed strictly as per the instructions in Beechcraft Service Instruction No. 0401-254 Revision 1. Compliance involves an initial inspection within 25 hours of time in service after 25 February 1972, or within 100 hours if the aircraft was already inspected under a preceding issue of this directive. Subsequent inspections must occur at intervals not exceeding 100 hours of time in service. This regulation does not explicitly mention any exclusions or exemptions, and its application is extended through subordinate instruments such as service bulletins and instructions issued by Beechcraft.

Key Provisions

The Civil Aviation Regulations 1998, specifically Part 39 - 105, mandate certain airworthiness directives for the Beechcraft 33 and 35-33 (Debonair/Bonanza) series aeroplanes. These regulations, set forth in AD/BEECH 33/10 Amendment 1, pertain to the propeller governor control linkage for specified models of these aeroplanes. According to section 2/72, these requirements apply to models 35-33, 35-A33, 35-B33, 35-C33, 35-C33A, E33, F33, E33A, F33A, E33C, and F33C, which are equipped with governors not incorporating Woodward SB No. 33535. The directive mandates that these aircraft must be actioned in accordance with Beechcraft Service Information (SI) No. 0401-254 Revision 1. The obligations imposed by this directive are clear and stringent. Firstly, the aeroplanes must comply with the directive within 25 hours of time in service following 25 February 1972. If the aeroplanes have already been inspected under the preceding issue of this directive, compliance must be achieved within 100 hours of time in service following the same date. Once these initial compliance periods are met, the aeroplanes must adhere to the directive at intervals not exceeding 100 hours of time in service thereafter. This ongoing requirement ensures that the propeller governor control linkage is regularly inspected and maintained to prevent potential safety issues. Failure to comply with the provisions of the airworthiness directive could result in serious consequences. While the Civil Aviation Regulations 1998 do not explicitly outline specific penalties for non-compliance in this instance, failure to adhere to airworthiness directives generally could lead to enforcement actions by the Civil Aviation Safety Authority (CASA). These actions may include the issuance of compliance orders, fines, or other regulatory penalties. Additionally, operating an aircraft that does not meet these safety standards could result in severe civil or criminal liability if an accident occurs due to non-compliance with airworthiness directives. Thus, it is imperative for operators and owners of the specified Beechcraft models to strictly adhere to the outlined requirements to avoid potential legal and safety repercussions.
