Overview

The Civil Aviation Regulations 1998, under the authority of the Australian Government, addresses various aspects of civil aviation safety and operations. Specifically, Part 39, which pertains to the Civil Aviation Safety Authority, includes Schedule of Airworthiness Directives to ensure the safety and airworthiness of aircraft. One such directive, AD/BEECH 200/36 Amendment 1, was introduced to address issues with the horizontal stabiliser forward spar web rivets in Beechcraft 200 (Super King Air) Series Aeroplanes. This legislation was enacted to mandate regular inspections and replacements of rivets with screws to prevent potential structural failures. The policy objective is to maintain the safety standards of the aircraft by mitigating risks associated with the identified rivet issues. The requirement to replace rivets with screws must be adhered to before the aircraft accumulates 2000 hours of time in service, and subsequently at intervals not exceeding 500 hours, ensuring continuous compliance with safety regulations. The effectiveness of this directive began on 31 March 1994, following the identification of rivet issues in the specified Beechcraft models. The directive aims to terminate the ongoing repetitive inspections through a defined corrective action, ensuring that the identified safety concerns are adequately addressed to prevent any potential in-flight incidents.

Scope and Application

The Civil Aviation Regulations 1998, specifically Part 39 - 105, addresses the safety directives applicable to certain Beechcraft 200 (Super King Air) Series aeroplanes, as detailed in the Airworthiness Directive AD/BEECH 200/36 Amendment 1. This directive applies to Model 200 and B200 aeroplanes with serial numbers BB-2 through BB-785, Model 200C aeroplanes with serial numbers BL-1 through BL-17, and Model 200T aeroplanes with serial numbers BT-1 through BT-16 and BT-18. The legislation mandates that action be taken in accordance with Beechcraft Service Instruction 1192, requiring the replacement of rivets with screws in the horizontal stabiliser forward spar web. Compliance is required before the aeroplane accumulates 2000 hours of time in service, and then at intervals not exceeding 500 hours until all rivets are replaced. The directive is applicable across the Commonwealth of Australia, under the purview of the Civil Aviation Safety Authority, and no exclusions or exemptions are stated in the provided text. This amendment came into effect from 31 March 1994, building on the initial directive issued on 31 October 1981.

Key Provisions

The Civil Aviation Regulations 1998 (Cth), particularly Part 39 - 105, outlines specific airworthiness directives for various aircraft, including the Beechcraft 200 (Super King Air) Series Aeroplanes. Under Section AD/BEECH 200/36 Amendment 1, it mandates specific actions concerning the horizontal stabiliser forward spar web rivets. This directive applies to certain models and serial numbers of the Beechcraft 200 series aeroplanes, namely the Model 200 and B200 with serial numbers BB-2 through BB-785, Model 200C with serial numbers BL-1 through BL-17, and Model 200T with serial numbers BT-1 through BT-16 and BT-18. The requirement outlined is to follow the action stipulated in the Beechcraft Service Instruction 1192. This directive imposes specific obligations on the owners and operators of the affected aircraft. They must ensure that the horizontal stabiliser forward spar web rivets are replaced with screws as per the Beechcraft Service Instruction 1192. The compliance must occur before the aircraft accumulates 2000 hours of time in service and subsequently at intervals not exceeding 500 hours of time in service. The initial compliance period for this directive began on 31 October 1981, and Amendment 1 became effective from 31 March 1994. Failure to comply with these airworthiness directives can result in serious consequences. The regulations do not explicitly state the penalties for non-compliance, but non-compliance with airworthiness directives can lead to significant legal and operational repercussions. The Civil Aviation Safety Authority (CASA) may impose penalties, including fines and operational restrictions, on aircraft that do not meet the specified requirements. Additionally, failure to comply with airworthiness directives can result in the grounding of the aircraft, preventing it from operating until the required actions are taken. This could have severe financial implications for the operators, as well as potential safety risks if the non-compliance involves critical components of the aircraft.
