COMMONWEALTH OF AUSTRALIA (Civil Aviation Regulations 1998), PART 39 - 105 CIVIL AVIATION SAFETY AUTHORITY
SCHEDULE OF AIRWORTHINESS DIRECTIVES
AIRWORTHINESS DIRECTIVE
For the reasons set out in the background section, the CASA delegate whose signature appears below issues the following Airworthiness Directive (AD) under subregulation 39.1 (1) of CAR 1998. The AD requires that the action set out in the requirement section (being action that the delegate considers necessary to correct the unsafe condition) be taken in relation to the aircraft or aeronautical product mentioned in the applicability section: (a) in the circumstances mentioned in the requirement section; and (b) in accordance with the instructions set out in the requirement section; and (c) at the time mentioned in the compliance section.
Agusta A109 Series Helicopters
AD/A109/32 Rescue Hoist 13/2002 DM
Applicability: Model A109 helicopters equipped with a Breeze Eastern Aerospace rescue hoist series BL-16600, excluding BL-16600-160.
Requirement: Perform a one-time inspection of the rescue hoist mounting bracket in accordance with Breeze Eastern Customer Aerospace Advisory Bulletin CAB-100-56, dated 11 November 1997.
Note: FAA AD 2002-20-05 Amdt 39-12901 refers.
Compliance: Before the next usage of the rescue hoist after 6 November 2002, unless already accomplished.
This Airworthiness Directive becomes effective on 6 November 2002.
Background: The FAA received reports of cracked rescue hoist mounting brackets. Such cracking could result in mounting bracket failure and separation of the rescue hoist from the helicopter.

Delegate of the Civil Aviation Safety Authority 1 November 2002
Overview
The Civil Aviation Regulations 1998, as part of the broader legislative framework for aviation safety in Australia, were enacted to ensure the safety of civil aviation operations. This particular legislation, specifically addressing Agusta A109 Series Helicopters, was introduced to address a safety issue identified with the rescue hoist mounting brackets on certain models of these helicopters. The Civil Aviation Safety Authority (CASA), acting under subregulation 39.1(1) of the Civil Aviation Regulations, issued this Airworthiness Directive to mandate a one-time inspection of the rescue hoist mounting brackets. This measure was implemented in response to reports of cracked mounting brackets, which could potentially lead to the failure of the rescue hoist and its detachment from the helicopter, thereby posing a significant safety risk. The directive aims to ensure that these inspections are carried out before the next usage of the rescue hoist following 6 November 2002, aligning with the advisory bulletin issued by Breeze Eastern Aerospace on 11 November 1997.
Scope and Application
The Civil Aviation Regulations 1998, specifically Part 39, includes Airworthiness Directives (ADs) issued by the Civil Aviation Safety Authority (CASA). These ADs apply to certain aircraft and aeronautical products to ensure safety standards are maintained. In this particular case, AD/A109/32 concerns Agusta A109 Series Helicopters equipped with a specific model of rescue hoist manufactured by Breeze Eastern Aerospace, excluding model BL-16600-160. The directive mandates a one-time inspection of the rescue hoist mounting bracket following guidelines outlined in a specific Aerospace Advisory Bulletin (CAB-100-56) to address the risk of cracked mounting brackets that could lead to the hoist detaching from the helicopter. This AD is effective from 6 November 2002, and compliance is required before the next usage of the rescue hoist following that date, unless the inspection has already been conducted. The directive applies across the Commonwealth of Australia, with CASA being the regulatory body overseeing compliance and enforcement of such aviation safety mandates.
Key Provisions
The Civil Aviation Regulations 1998, under Part 39 - 105, include an Airworthiness Directive (AD) specifically addressing the safety of Agusta A109 Series Helicopters equipped with a Breeze Eastern Aerospace rescue hoist series BL-16600, excluding BL-16600-160. This AD, identified as AD/A109/32 Rescue Hoist 13/2002 DM, mandates a one-time inspection of the rescue hoist mounting bracket (section 1(a)). This inspection must adhere to the instructions outlined in Breeze Eastern Customer Aerospace Advisory Bulletin CAB-100-56, dated 11 November 1997, and must be performed before the next use of the rescue hoist following 6 November 2002, unless it has already been completed (section 1(b) and 1(c)). The directive was issued due to reports of cracked mounting brackets that could lead to failure and separation of the hoist from the helicopter, thus posing a significant safety risk.
Under this legislation, the operators of Agusta A109 Series Helicopters with the specified rescue hoist must ensure that the required inspection of the mounting bracket is conducted as stipulated. This involves adhering to the precise inspection protocol detailed in the advisory bulletin. The AD specifically targets the mounting bracket of the rescue hoist, making it imperative for operators to comply with these safety measures to maintain the airworthiness of their aircraft. Compliance with the AD is mandatory and forms part of the broader regulatory framework designed to ensure the safety and reliability of civil aviation operations.
Violation of the requirements set out in this Airworthiness Directive can lead to serious consequences. The AD is a regulatory tool designed to prevent unsafe conditions that could compromise flight safety. Failure to comply with the directive's requirements may result in the grounding of the affected helicopters until the necessary inspection and any required repairs are completed. Furthermore, operators found to be in non-compliance may face enforcement actions, including fines and other penalties as prescribed under the Civil Aviation Act 1988. The specific penalties for non-compliance are not detailed within the AD itself but would be subject to the broader provisions of the Civil Aviation Regulations and related legislative instruments.
