Overview
The Illegal Logging Prohibition Amendment (Strengthening Measures to Prevent Illegal Timber Trade) Act 2024 was enacted to address the problem of illegal timber trade, building on the provisions of the Illegal Logging Prohibition Act 2012. This Act was introduced to strengthen the measures against illegal logging and ensure more stringent enforcement to combat the environmental and economic impacts of illegal timber trade. The policy objective of the Act is to enhance the existing framework to prevent and deter illegal logging activities, ensuring compliance with international and domestic standards. The Act was assented to by Her Excellency the Governor-General on 17 September 2024, following its passage by the Senate and the House of Representatives in the Parliament assembled. The amendment aims to reinforce the regulatory environment and improve the effectiveness of measures designed to protect natural resources and support sustainable forestry practices.
Scope and Application
The Illegal Logging Prohibition Amendment (Strengthening Measures to Prevent Illegal Timber Trade) Act 2024 applies to any person or entity involved in the timber industry, including but not limited to logging operations, timber processing, and the importation or exportation of timber products. This Act extends its jurisdiction across Australia, impacting both state and territory jurisdictions to ensure uniform enforcement against illegal logging activities. The Act seeks to strengthen measures against illegal timber trade by imposing stricter penalties and enhancing compliance mechanisms. The Act does not explicitly mention exclusions or exemptions, but it is likely that certain activities related to sustainable forestry practices or approved timber operations may be excluded. The application of the Act may be further refined or extended through subordinate instruments, such as regulations or guidelines, which could provide additional definitions or operational details.
The Treasury Laws Amendment (Financial Market Infrastructure and Other Measures) Act 2024 applies to corporations and other entities involved in financial markets within Australia. This includes financial institutions, clearing houses, and any entities that facilitate transactions within financial markets. The Act aims to enhance the regulation and oversight of financial market infrastructure, ensuring stability and integrity within these systems. The legislation's jurisdiction covers the entire Commonwealth of Australia, thereby affecting entities across all states and territories. The Act does not detail specific exclusions or exemptions but implies that certain small or non-systemic entities might not be subject to its full scope. The application and enforcement of this Act may be supplemented by regulations or other legislative instruments that provide further clarification or additional measures.
Key Provisions
The Illegal Logging Prohibition Amendment (Strengthening Measures to Prevent Illegal Timber Trade) Act 2024 (No. 84 of 2024) amends the Illegal Logging Prohibition Act 2012 to enhance measures against illegal timber trade. Among its key provisions, Section 5 introduces stricter penalties for breaches of the Act, while Section 10 requires businesses to provide detailed documentation of timber sourcing to ensure compliance with the Act. Additionally, Section 15 mandates enhanced monitoring and reporting requirements for businesses involved in timber trade to prevent illegal activities (Sections 5, 10, 15).
The Net Zero Economy Authority Act 2024 (No. 85 of 2024) establishes the Net Zero Economy Authority, an independent body responsible for guiding Australia towards achieving net zero emissions by 2050.
